Overseas when PCN issued, no right to appeal, Excel parking Lichfield

    I'm about to send my SAR.  Think its better to get it in early than wait for the LBC.

    Question:  As the machine was ticketless can I still request a PDT record from the machine with redacted VRN's?

    This is what I'm requesting.  Anything else worth adding?

    ·       ALL photos taken of myself or my vehicle

    ·       ALL letters/emails sent and received

    ·       A PDT record from the payment machine for the ****** of payments made, with partially redacted VRN’s

    ·       ALL data held

    ·       ALL evidence you will rely on

    ·       A full copy of the Parking Charge Notice and Notice to Keeper

    ·       A list of any other outstanding PCN’s against myself or this vehicle.  Any claim must be for all PCN’s and not several claims.


    Do these requests look ok? I've tried to be specific when asking for VRN's, hence the partially redacted, not redacted bit.  Then if they fully redact I can claim they are being unnecessarily obstructive.

    You can ask for anything you like. Just note that the PPC are only obliged to supply your data, so they may not comply with a list of partially redacted VRMs, but should at the very lease supply yours.

    If they don't supply the list, when writing my defence can I put them to strict proof that the machine was fully functioning on that day, that there had been no system outages and when the machine was last checked for serviceability?

    Yes, a short reference to it, then an expansion of the point in your subsequent Witness Statement.

    The VRN list from the recent case (that was won) shows some very random VRN's. Fruitcake remarked that there may have been a classic car rally :)

    The VRN list from the recent case (that was won) shows some very random VRN's. Fruitcake remarked that there may have been a classic car rally :)
    It's gone in now.

    I asked for partially redacted so they'd have less of a chance to argue about giving away other data.  Not that any of it may pertain to me as they are claiming I didn't pay.

    What was the date and time of the transgression please?  I can check with the FB group if anyone has a VRN record for that day.

    I have popped home from overseas to the inevitable LBC from Excel.  Good job I did, because even though my wife had been checking my mail this got missed.  I have just over a week to respond.

    Is there any significance in that it has come direct from Excel and not DCBL/Gladstones etc?

    Also on page 2 it says that "We do not accept service of any documents by email."  Does that mean that they won't even accept my request for a 30 day hold by email?

    All the other stuff was the usual gumph.  This seems to be moving along quite quickly compared to the majority of other cases I have read about on the forum.
