Overseas when PCN issued, no right to appeal, Excel parking Lichfield

    So today I received a final demand dated 24/8 and claiming it was posted that day, giving me until tomorrow to pay.  NO CHANCE.

    I haven't done this, as when I found out about the claim I was past the first stage, but is it worth emailing my MP to highlight that even though they lost the contract Excel are still pursuing dodgy claims.

    Yes - MP complaints are always worth doing, if only to encourage your MP to take a keen interest in the stalled Code of Practice and upcoming Public Consultation to get the damn thing over the line.

    However, a parking firm can pursue and issue a court claim over an historic PCN,  issued at a site they used to infest before they were dumped.

    @Coupon-mad, thank you.  I understand they have the right to pursue an historic claim, I merely want to highlight to him, that right up until the death they were up to no good.

    No I have this "Final" demand i take it the next correspondence I'm waiting for is a LBC?  Is there a timescale for this, or just hurry up and wait?

    The timeframe to receive a LBC is any time between now and 60 days before six years are up. Any later than that and you would delay it enough to get it past six years when it will become statute barred.

    I'm writing my SAR, following the advice in the newbies thread, using the linked template.

    Question:  As the machine was ticketless can I still request a PDT record from the machine with redacted VRN's?

    This is what I'm requesting.  Anything else worth adding?

    ·       ALL photos taken of myself or my vehicle

    ·       ALL letters/emails sent and received

    ·       A PDT record from the payment machine for the ****** of payments made, with redacted VRN’s

    ·       ALL data held

    ·       ALL evidence you will rely on

    ·       A full copy of the Parking Charge Notice and Notice to Keeper

    ·       A list of any other outstanding PCN’s against myself or this vehicle.  Any claim must be for all PCN’s and not several claims.

    Yes ask for the PDT record. If you ask for a redacted record they might tamper with the record. They have form when it comes down to tampering with records.

    I still cannot work out what happens with these payments. Would need to speak to the merchant that accepts these payments. It does sound like the security levels are too high as this sort of issue happened a lot.

    In the post above that shows a declined message, the messages are not coming immediately. If they were declined by the paying bank I think that would be an immediate decline. This is a problem at the receiving merchant's end.

    You can also ask for the PCN History page from their system, showing the dates and status updates.  Can be useful.

    @Snakes_Belly I don't suppose you know when Excel took over the three spires parking in Lichfield do you?

    I'm trying to track down images to use in my WS and Google only goes up to Nov. 2020

    According to the petition it was 1st March 2021.
