Letter Before Claim - CST Law & Smart Parking Limited

CST/DRP/Smart Parking will come to nothing. I've not seen any court claim emanate with this trio being involved. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

It honestly baffles me how they are even able to operate, surely it can't be a profitable industry betting on people being scared enough to pay!patient_dream said:
Right so this is out ...JayH97 said:
Couldn't agree more, not only that but they didn't accept my appeal as it was outside of their timeframe to even look at it even though they have never issued me with a written PCN by post, nor have they ever ticketed my window! Absolutely no chance, they've been ignored throughout but this LBC letter from CST Law was a new one!patient_dream said:
Smart Parking are so stupid, it's their parking ticket but they want to pass the buck to their bed fellow DRP.JayH97 said:Hi All,
I've been a frequent browser in the threads for a while now since I received a parking charge notice from Smart Parking Limited. I originally (and stupidly) paid one of these at the discounted rate and thought that was the end of it. However, I also apparently got another parking charge the month prior to this, with no notification of such through the post, no posted sticker on the windscreen and the first correspondence I received was from Debt Recovery Plus. I then tried to appeal with Smart Parking to inform them that I'd never received any correspondence of this parking charge but was told due to the appeal being outside of the required time period, I would only be allowed to correspond with Debt Recovery Plus.
Now it's been around 6 months and I've finally received a LBC from CST Law on behalf of Debt Recovery Plus. I've done the SAR request to Smart Parking and also informed CST that I have done this.
Is there any route or further action I should be taking?
Thanks for any help in advance.

DRP are only money scammers and circus clowns who have added a fake £60/£70
NEVER EVER DEAL WITH DRP unless you want to have some fun with a scammer ?
CST LAW
Did they really say "on behalf of DRP" ??
DRP cannot instruct anyone because they have no power to do so.
CST Law fail to grasp this therefore making themselves look complete fools ....
LETTER BEFORE CLAIM
The instruction can only come from SMART. You must respond ...
1: Advising CST that you seeking debt advice and require them to extend their claim by a further 30 days. Not sure if CST understand this but under PAP IT IS THE LAW.
2: If they think that DRP instructed them, they will be happy to provide a parking ticket issued by DRP .... ???
3: What is their legal authority to add fake amounts
Seems CST Law don't want to answer these questions, never seen a reply from them ........ because they cannot
DRP as said are only money scammers, they are no more important than anything that lives in the sewers
Work this one out, Smart, DRP and CST Law are members of the BPA ?
That's just 3 scammers in the BPA membership, there are so many in this little club
THE HISTORY OF CST LAW ...... it really is a big jokeCST letters' forum group thread

Apologies no, it was that they are "instructed by Smart Parking Ltd to commence legal action against me to recover the amount outstanding", full with reply forms within 30 days. I've submitted my SAR request to the DPO at Smart Parking and also have emailed CST to advise of point one under PAP. I'm guessing now it's just a case of waiting for a Letter of Claim if it ever comes and then go through the MCOL thread?
I got in touch with the BPA funnily enough to raise complaints about all of them and that went little to nowhere, seems like it's completely acceptable to run a cowboy business ripping off elderly and working class people!
2: If they think that DRP instructed them, they will be happy to provide a parking ticket issued by DRP .... ???
Points 1 & 3 are still appicable and if they reply, they normally don't, we would like to see it.
Right now the BPA have been caught with their trousers down, very difficult to explain away a money scammer ? their members .... don't expect much.
End of the day if this went to court it's not Smart or CSTLaw who have the final say, it is the judge
CST Law with daft claims can only result in them being spanked, maybe why we don't see much action from CSTLaw apart from their scary letters
All these parking companies and their debt collectors make an absolute fortune from motorists who pay up because they are scared of the next stage.

CST are just the next desk to DR Plus and almost never actually file court claims. All part of Bristow & Sutor; considered by many right-thinking people to be waste of space bullies.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That's extremely comforting to know honestly. I've read a lot of the same online about the empty threats and it not leading anywhere, if anything the letters are more of an annoyance.Umkomaas said:CST/DRP/Smart Parking will come to nothing. It's beyond shocking but I guess it's the way of the world unfortunately. I was actually one of them who paid the first ticket that I got just to get it off of my desk. Not something that will happen again but a learning curve for sure. All these parking companies and their debt collectors make an absolute fortune from motorists who pay up because they are scared of the next stage.

Extremely good to know, I'll keep an eye out for anything actually real, and if they reply with any information regarding this I'll post an update. Shame to see that these bully squads are able to roll around and do what they do. I heard there was new laws and rules coming in to combat these companies?Coupon-mad said:

There are more than 9 million private parking tickets issued each year. Probably 5 million+ go unpaid. The courts couldn't possibly cope with 5,000,000+ county court hearings every year, or 19,230+ cases per day. Too many people assume that every case goes to litigation, just because it's threatened. Do the math!JayH97 said:

Following the SAR request to Smart Parking Limited, they got back to me surprisingly fast. The contents of which I find hilarious and may have given me all the ammunition I need for a defence? Any help is appreciated.
The parking notice itself is dated 30/10/2021. I have never before received a letter informing me of this PCN, nor any spot fines with a ticketed windscreen. The first I heard of this PCN was through Debt Recovery Plus.
Within the SAR request received, they have sent me a copy of the letter titled "notice to owner". This letter is dated the 11 August 2022. Does anyone know how long Smart Parking have to issue me with this via post, as they're about 9 months out haha.0
