    I had a look to find all the Port of Wells threads I could find today and not one of them wasn't discontinued. Amongst them is one where they hadn't paid the hearing fee. So on that basis I'm figuring I may as well wait to see if they do as, even if they do, I'll still have a month to get the WS written and submitted.

    And I'm just wondering, why would they bother pay the hearing fee and losing even more money? They clearly know they haven't got a leg to stand on and they're just wasting everyone's time, including their own (who am I to care that they're wasting their own time, paperwork, emails etc though) 

    They already know that I'm not someone who gives in.

    You're in a game of poker - who blinks first. 
    They already know that I'm not someone who gives in.
    You are dealing with a conveyor belt of their court cases all at different stages. They will have no idea who you are, nor will they care. They will march on until something makes them stop.  Keep going.

    Ok thanks for the perspective. And on the hearing fee, which is due for them to pay early August, I may as well wait to see if they've paid it as I'd still have plenty of time to get the WS done. Unless I'm missing something?

    What does the court order say (reverse page) about the submission of your WS and evidence bundle ('the documents on which you wish to rely')?

    The longer you leave the start of drafting your WS, the further you are from the date of the parking event (memory fail?), plus you won't believe how many who come here forget to action until too late, or have a real-life emergency that gets in the way and prevents them getting it done!

    Your timing is fortuitous because I suspect the date for them to pay this hearing fee is beyond the time when the new statutory draft Impact Assessment gets published...

    ...which (to be clear) I am GUESSING but I am quietly confident - and it's an educated guess/hope - that it might reveal that reason will continue to prevail re BANNING the added false fees.  As it did in 2022 when the scales finally fell from the DLUHC's eyes on this '£70 fake fees'  issue.

    I honestly think that the draft Impact Assessment will put the cat among the pigeons for any pending inflated court claims.  I can see loads being discontinued.

    Hope I am right.

    Do come back here in August and EVEN IF your case is discontinued:

    It says that the claimant has until 11th August to pay the court fee of £27 and if not the claim will be struck out.

    Goes on to say that the hearing will take place on the 8th of September. 

    All documents should be sent 14 days before the hearing.

    Thanks for this. So if I understand it correctly I may be able to quote from the impact assessment if it gets published before the time within which I have to submit the WS ?

    I'm really not sure what to do - if I wait to see if they pay the hearing fee, which is on the 11th August, I'd have a week, to compile the WS and get that sent off (end of which week is 14 days prior to the 8th of September), I reckon I could do it in a day so it'd still give me enough time, and if the IA gets published before this, then I can include that. 

    Or do I write it this week and get it submitted this week. It would be done and 'out of the way' but I wouldn't be able to include any ammunition from the IA?

    You're the expert Coupon-mad, what would you advise?

    Wait for the Impact Assessment.

    Come back here end of July to discuss it and take part in the Public Consultation.  Be heard!

    Then use whatever 'sweeties' the Impact Assessment hands to you.  The Minister didn't hold back last time in 2022 where he called out excessive 'fees' as "extortion".

    I am hoping for some really useful stuff.
