ccj for parking fine

Options
Hi,

I'm looking for some advice please.

I've recently discovered, upon looking at my credit report on clearscore, that I have a ccj. I've phoned up this morning to find out what it was for, as I didn't receive any claim forms.

The ccj was set in April this year for £343, and was for a parking fine incurred in 2018. I've been given the phone number and reference number and their website is ce-service

The address showing on the ccj is an old address I moved out of in 2016. It was demolished a few years ago and no longer exists.

What can I do about getting this set aside ?

Thanks for any help.

First step is to read the NEWBIE sticky second post where you will find info on how to have a CCJ set aside.  You could phone CCBC (ask Auntie Google for the number) and ask them who the claimant was and to where they sent it.  They might also (if you get a kind operative) send you a copy of the claim form.
Be careful when applying for the set-aside as judges do not like credit cleansing so you will have to go with claim not served properly.

Also if you moved out in 2016 and the charge was in 2018 when did you update the DVLA about your move?

If the Judgment was made in April this year without your knowledge, it seems likely that the Claim was issued to the then non-existent address around the end of last year or the beginning of this year.
That seems to be well after the property was demolished.

I have no idea what Royal Mail does with mail that obviously cannot be delivered in this type of situation. Do they try to return to sender - i.e. to the CCBC or do they simply throw it away?

But apart from that, what were Civil Enforcement thinking about - sending a Claim to an address that they had heard nothing from for several years?

    Thanks for the reply.

I've rang the CCBC and asked them who the claimant is. It's civil enforcement limited, although I didn't ask where they sent it. I'll phone them again and ask them where it was sent and for a copy of the claim form.

    Okay, thanks.

I rang the DVLA and asked them what the address on the V5C was in 2018 for that car, which I no longer own. But they have said I have to write in and it'll be several weeks before I get an answer. Is there a quicker way?

I just phoned them, and the lady I spoke to said it was sent March 25th 2022 by Royal Mail, and that it wasn't returned to Royal Mail as undelivered.

How could that be when the building was physically demolished?

So it was sent to the wrong address.

Same as any othef CCJ set aside thread. Good recent ones to copy from are by @Jack5656 or @msx999 or @GlassRoof36

Thank you, just having a read of Jack5656's post - so your first reply to the OP would also apply with me as well, in that you think I would be successful in having it set aside?
