I have a load over on FTLA but, to be honest, the modus operandi is now well established and is there still a requirement to post the obvious? I know you are collating 'evidence' but it is already a 'given' that any defence, no matter how poor or irrelevant, any claim issued though DCB Legal will be discontinued before the hearing fee has to be paid.

The more we can collect on the DCBL TIMEWASTERS, the better.

I’ve been following the discussion thread closely, and it’s evident that many of the cases which were ultimately discontinued hinged on the same mitigating circumstances that the motorist have outlined in their original appeal.

Despite this consistency, parking operators routinely reject appeals, repeatedly threaten court action, and recycle the same narrative to debt collectors - only to be ignored. Then they issue a claim, Defendants rely on the identical facts in Paragraph 3 (“facts known to the defendant”), DCBLegal  “signal their client’s intent to pursue the matter” , dragging it out unnecessarily. When the time comes to pay the trial fee, they discontinue the claim at the last moment.This repeated pattern of issuing claims without a genuine intention to proceed, only to withdraw when scrutiny is imminent, is what’s known as Grovit abuse. 

It’s a strategic misuse of the court process used to harass and burden defendants while sidestepping judicial accountability.

If sufficient evidence is collated showing this pattern across multiple cases involving the same claimant, it could form grounds to issue a separate action under the tort of abuse of process, specifically invoking principles established in Grovit v Doctor.

Grovit and Others v Doctor and Others [1997] 1 WLR 640 (HL)

This House of Lords decision clarified that maintaining proceedings with no genuine intention of pursuing them to conclusion constitutes an abuse of process, even in the absence of proven prejudice. Lord Woolf famously stated:

“To commence and to continue litigation which you have no intention to bring to conclusion can amount to an abuse of process.”

Here's another discontinued claim from the Facebook groups.  This one is particularly interesting because the Defendant had a mediation call earlier today (29/07) and then received this by email shortly afterwards.

In completely unrelated news, the hearing fee due date was 30/07.  Number 625 I believe.

@Tyro123_2 brings us news of a discontinuance at court level from a couple of weeks ago, but the actual NoD being sent out late by DCB Legal. @Coupon-mad considers whether this may be a new delay tactic in the hope of a last minute panic payment by the Defendant as the (cancelled!) hearing date approaches.Nonetheless, 3-2-1, Tyro puts the Pyro up UKPC and DCB Legal 🧨.
