  • hello helpful people,

    My hearing date is 15th Mar 2023.

    I have been reading through THE HEARING section of the newbie tread.

    This is first time I am going a court a bit nervous.

    1.       After AOS there were a few letters from claimants solicitors about settling the case, as advised ignored those. Can they use it against me at the hearing? any advice if they bring it up?

    2.       When I joined the virgin health club for 1 month to check it out. I was told 12 hours parking available by the person showed me around as it could be use for work from home etc. But I do not have a written proof. I was not given a starter pack with any terms and conditions. 

    however, Claimant’s solicitor mentioned parking allowed is only 4 Hours, but their WS does not provide a proof. Other than mentioning that the gym members should be aware of 4 hour time limit.  

    this is a point I am going to mention in addition to unclear signage. Any thoughts please ?

     

    3.       I’m going to take both WS and my crib sheet with me in for the hearing. Should I take anything else?

    If you have put those points in your defence and witness statement you can talk about them at the hearing.  Take a spare copy of your WS in case judge/claimant tries to claim they didn't receive them and take a copy of your defence for reference.

    Without prejudice offers CANNOT even be mentioned at the hearing, so relax (except when it comes to costs right at the end, which is when you ask for your costs).

    BWL has quoted several sections of the my Defence on their WS.

    i know its short time available. any advice would be appreciated?

    Don't panic, had exactly the same wording. We won, Judge threw their case out before even questioning the Defendant - despite voicing displeasure about the "copied from the internet" stuff.
