What is more annoying is that once again we read about claimants being given more leeway than a defendant when the defendant is an individual with no knowledge of the legal processes whereas the claimant and their solicitors do this for a living - note I did not say professional!3

I dont really care what it says but if they filed it after the cutoff date in the letter shouldnt the case be struck out?0

What should have happened and what has happened are two different things. Move on. I can’t see you have actually complained to Aldi which you could still do. In the meantime I suggest you start drafting your WS2

Received notice of allocation to the small claims track (hearing) in May
It say claimant has to pay £27 to the court trial fee by April 26 or file a properly completed application (ie one which includes all required information in the manner requested) for their help with fees or else the claim will be struck out and they will be liable for cost which I have incurred.
Now i have to file with the court all evidence which i intend to rely on by feb 14.
UKPC has just emailed me without prejudice seeking to settle at £200 which is more than they offered the first time. Havent replied.0 -
Don’t bother with their offer. They are obviously not that confident that they will win and probably don’t want to pay the fee or the cost of a paralegal to present their case.
Worst case scenario for you is likely to be about £200 if a judge found in their favour. Even if they won it will cost them that much. Best case is they cut their losses and choose to discontinue.2 -

does my witness statement say all the same stuff i wrote in defence?
all i have is the person who was with me who can attest to the parking meter being covered and taped off. i dont have a lot more i can say as i was unable to recover the photo of it from the day off my old broken phone0 -
