Claim and information overload

HI I will keep it as short and truthful as possible

Parked in Asda lot and the Pay thing was covered in a hood and taped off so I parked assuming they can't expect payment
Got a ticket and ignored it as it wasn't council issued
Moved house and updated license but not V5
They have been sending info to old address
When I bought a house they suddenly got this address and send the letter before claim
I asked for extra time and explained and she said it was my fault should have updated V5
Now I have claim dated July 1st so service date is considered July 6 and acknowledgement July 20

I have learning difficulties and have trouble with all the threads and information.
I don't think its fair they tacked on all this money but I feel like its easier to just pay the £296
I don't have anyone here who can help me and its just too much information as I am unwell.
My question is 1) is it worth filing a defense and 2) if not how do I pay this so they report it properly and it doesn't go to court?

Thank you

It is worth fighting and we will help, please don't pay.

You are correct to file the AoS (acknowledgement) by 20 July, but there is no reason to wait. Do that online asap.

You will then have until 3 August to file your defence.

Which parking firm, and who are the solicitors representing them?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

There are 2 sticky threads that you need to read,

**NEWBIES!! PRIVATE PARKING TICKET? OLD OR NEW? **READ THESE FAQS FIRST!** Thankyou!

    And

Template defence to adapt for all parking cases where they add false admin costs - edited March 2022

This second one gives you your defence, you only need to edit and add a few paragraphs at the beginning - the ticket machine out of order / not working. Should be an easy win. You do not need to change anything in paragraph 4 onwards.

Take your time and go slowly, re read these as many times as you need to (I did). You have plenty of time (over 2 weeks) to prepare and submit your defence. In that time you need to wise up to the bullying tactics used by these rogue PPC and their solicitors and be prepared to fight back to win.

Start following some threads and search the forum for similar cases, after a few days you should start to understand how to use the template above.

ASDA - do they still use Smart parking?

Was the legal BW Legal or DCB Legal? (Or someone else?)

In your complaint to ASDA you should tell them you and everyone you know will no longer shop at ASDA if every visit had the potential to cost an extra £100 or more

I don't have anyone here who can help me.
But you have a whole team of us here who will! And a template defence, so it is easy.

With a Claim Issue Date of 1st July, and having filed an Acknowledgment of Service in time - do that now - you have until 4pm on 3rd August to file your Defence.

Plenty of time to produce a Defence, but please don't leave it to the last minute.

To find our Template Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try to 'Start Defence' via the MoneyClaimOnline website. Leave that alone!  Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'. Defence and the subsequent N180 form (see NEWBIES thread) is done by email.

Wow thank you everyone I didn't expect so many responses!

And it was Aldi not Asda - sorry!
It was UKPC and the attorneys are DCB Legal.
So should I acknowledge and say I want to defend all of the claim or just part?

Also if they find against me will I get a CCJ on my credit report? I am terrified of that.

I've advised you where to read to defend IN FULL and how to do it.  And it's not done in the 'start defence' section online.

    🤣🤣🤣🤣🤣

You naively think them to have any intelligence. ;)

The only chance of getting a CCJ on your credit file (there's no such thing as a report - that's a made-up term the reference agencies use to try and get money from people) is IF:

    a) You lose in court AND
    b) You fail to pay the judgment amount in the relevant time

    a) is by no means a certainty (forum-assisted defences have a very high win rate)
    b) is entirely within your own control

    :)
