    Hi just an update I received a 'General Form of Judgement or Order' from the court today saying the claimant hadn't filed their directions questionnaire and they had 7 days from date of letter (oct 13) to do so or it would be struck out. Will keep you posted.
  • Hi today I received a Notice of transfer of proceedings.

    Small claims mediation team has arranged for case to be transferred to a hearing centre as they were not able to arrange mediation.

    Transferred to local county court hearing centre for allocation. On receipt, the file will be referred to a judge who will allocate the claim to track and give case management directions. Details of judges directions will be sent in the notice of allocation.

    If I need any other info contact the court but otherwise await judges directions.


    So my post above this was about the letter saying the claimant had failed to file the directions questionnaire and they had 7 days to do so. Does this mean they have now done this and the case is going ahead?

    Just like you sent a copy of your completed DQ to the Claimant, the Claimant should also send a copy of their completed DQ to the Defendant.
    Did they do that?

    A requirement.  But no-one cares if they didn't copy in the defendant to a DQ because the Courts (at least in small claims) are invariably seen to cut Claimants a huge load of slack.

  • Just checked moneyclaim.gov and it now says 

    Claim History

    - General sanctions order was made on 13/10/2022

    - DQ filed by claimant on 23/10/2022

    - Your claim was transferred to xxx on 10/11/2022

    So even though they had to file the DQ by Sept 26 or it would be struck out, they were alliowed to do it a month later and now its proceeding. How can I get a copy of what they filed? Can I email the ccbc email?

    It's exactly the same form that you have completed. There should be nothing particularly of interest on it.  What specifically do you want to see from the Claimant's DQ. 

    If you really want to look at it, you could email the CCBC and ask for a copy - see how they respond.
