Shall I just wait now to see what evidence they bring before starting any witness statement?

Do they have to play the game properly and issue me with documents by 2nd May or the claim will be struck out? or will they try and delay passing me the info like they did with payment of the CCJ etc
You should start preparing your WS so that you are ready to file it before the deadline. No harm in leaving it to the last minute before sending it as it gives you a chance to amend and rebut anything in the Claimant WS, should they file and send your copy of theirs before the deadline. Of course, it could be that both of you play the same game and file at te last minute.
If the Claimant files/serves at the same date as the Defendant, then the Claimant is in breach of the NOA. ;)

I'm going to start the witness statement next week :) should I be expecting the N180? I havent received anything in the post from the courts, or BWL either
  • You can check your MCOL history, that will tell you if the Court has sent the N180 yet.

You've had the Notice of Allocation ... there's already a hearing and court defined (allocated) - 14-Jul-23 in Southampton - so you're way past N180 defence questionnaire. Ignore MCOL now - it takes no further part in this claim.

Hi @Jenni_D, works got in the way of starting the WS this week just gone. I've been working 7am-8pm 6 days a week (not looking for sympathy, bad planning and self inflicted), however the point is; if I dont receive anything on 2nd of May will the case been thrown closed? if so, do I need to notify the court or anything that they've failed to meet the deadline?

OR, like before, can they do it a couple of days late and get away with that? and I will definitely need to start my WS urgently?

The second option. They'll probably do it late and no-one will care. It WON'T be thrown out.

Make sure you do everything right.

As yours is a post-CCJ set aside hearing there was no N180 stage for this one.

    Thanks @Coupon-mad, I hope you're well.

I'll find some time to start on the WS and post shortly. I kind of wanted their evidence to so I could base it around that for ease, but I'll guess I have to add responses afterwards.

so even if they dont serve me or the courts anything, the hearing will go ahead??

@Coupon-mad should I still use the WS in the newbies thread as a basis? or have you already seen successful WS for this spot that might be a better basis to start? I remember having trouble finding previous posts regarding this area, but it is well known
  • IIRC you have already had the CCJ set aside?

If so you can adapt the WS by @aphex007 and @SJRRJS.
