    Second call, some absolute plumb, which is what I expected from the first one but the first seemed actually vaguely human and reasonable. Still had my guard up. 

    So it's been left as above, would you accept that as being served? I dont know what else I could do if it kept bouncing the email back as spam! I was giving a first name, but couldn't get any other details apparently, like a second name. but I noted down both the first caller and the seconds first name, and time of call. 

    The last guy said a case handler will look into it and be in contact, he couldn't give a time frame. He also chucked in, normally you have to pay first ... yeah nice try. Told him no chance. 

    Oh and ironically, to pass 'security' ... I had to give my address, which is my current and correct address it would appear. 

    What another mess for something on paper should be simple  :dizzy: however its definitely their server, I had our IT see if he could do anything 
  • I wouldn't take his word for it, nor rely on the recording. You need written confirmation that they have received all the emails.

    The first chap said he couldn't confirm in an email as he's not allowed to send emails. 

    I have 3 automated replies, but it doesn't tell you which emails got sent and the guy told me the documents he received, but only over the phone. 

    what do I do in this scenario? I've tried dropping out attachments one by one to see what it is, changing the body of the email, sending from 2 other accounts, they have all bounced back. 

    Just follow it up with an email like I posted on here?

    I honestly don't know, what I do know is I wouldn't trust either of those guys as far as I could throw them. Can't send emails my @rse!!

    From what the 2nd guy told you, does that tally with the acknowledgments you got? If so have they received everything you needed to send?  

    Hopefully someone will have a better idea.

    Same. 

    So parking@bwlegal.co.uk had received everything and he listed the attachments on the phone. They actually got a duplicate email where I had changed the name of the attachment from "Experian report" to "defence report", as my IT guy had thought the word Experian would likely be trigging their server into thinking its spam. So I asked he didn't send on that version and explained why. 

    I'm panicking a little, as I read somewhere 14 days before the hearing, but then @Coupon-mad also said there isn't a deadline with set a side case? 

    I'll go have a glass of wine and wait to see if anyone else knows what to do in this situation and keeping checking in tonight

    hearing is 17th February

    Im relaxed :) a year with this, I'm so excited to have my day.

    They may be confused by repeat emails, just slightly varied, but I have nothing in writing back from them though? The auto responses could have been to 3 of the 20 emails to them, it doesn't tell you which was received. Ironically the 1st guy said he had 4 emails

    Well, the predictable has happened, I welcome your thoughts all.

    A year I've been forced to live with this CCJ and its restrictions! I just received an email from BW legal,

    WITHOUT PREJUDICE SAVE AS TO COSTS
    We write in reference to the above matter and your Application to set aside the judgment entered against you on 8 April 2022.

     As you assert to not receiving the Claim Form and not having the opportunity to respond to the claim, Our Client is willing to consent to your Application, should you agree to the terms of the enclosed Draft Consent Order on the following basis:

    1. As this is your application, you are responsible for filing any agreed Order; and
    2. Please note that the Court require a fee of £100.00 to approve the Order, and our Client is willing to cover this cost in order to set the judgment aside.

    I guess its pointless writing back asking for the £275 N244 money back, the CCJ removed and the original claim to be struck off?

    I'm happy to take them all the way, its been a long time living this I'm not shying anyway from anything

    Counter-file your own draft order? If you've paid for a set-aside then you absolutely should be seeking repayment for it. Plus you should be taking the "not properly served in time / 4 months dead" angle, to argue that the claim is struck out?
