Excel Parking still getting mentioned on TV news. Sunday lunchtime BBC1 news presenter tells viewers about Excel dropping it's court claim against Rosey Hudson, Excel didn't say why they dropped the case.5

I would also be adding a paragraph to the defence template stating that the claimant's very own solicitor has previously forwarded £60 from a defendant's previously paid ticket to a charity following critical media coverage and the discussion of the case during a Parliamentary debate, when they were referred to as "rip-off charges."6 -
I firmly believe that Excel (and VCS) will prove toxic for the private parking sector. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

On the Vine show around 12:45 referring to the old favourites DCB Legal and the Rose Hudson case in Derby, how they abandoned before getting to court.
Unfortunately Vine cannot string an argument together and could not highlight the real issue, the persistent abuse of the court system to bully people to pay unconscionable sums to these robbers.

More bad publicity for Excel Parking. This time the criticism is on the type of paying machine Excel install in the car parks they manage.Excel choose machines that allow motorists to pay without proper procedure. They state the car registration has to be input with payment yet Excel's machines will take a payment issue you a ticket even when car reg. is not entered. As Catherine Atkinson MP said "It’s completely unacceptable for private parking companies to penalise people for their own system flaws."The motorist has been threatened with “sheriff court proceedings” if the £170 payment isn’t paid within a week of the letter being received. After discontinuing the Rosey Hudson case it will be interesting to see if Excel with their flawed systems have the confidence to try a court claim in Scotland.6

Not a chance in hell will they raise a court claim in Scotland for £170 ... simply won't happen.Jenni x6

I believe the last time it happened in Scotland for a single PCN was about 10yrs ago. UKPC filed four claims against Gallacher retail park drivers. UKPC then dropped the cases before the Forfar court hearings.5

Follow-up on Dec 1st posts:ParkMaven responds to concerns raised and blames cameras for generating incorrect PCNs at Chadburn Centre in Paston."The camera was incorrectly picking up vehicles that returned to the car park the next day/s and was not logging them out on the initial visit resulting in tickets being issued."Come on ParkMaven that's not the cameras fault. Whoever set the camera system up is at fault here.9

Notice the incorrect use of the word "fines" by ParkMaven in their quote. They didn't issue any fines, just speculative invoices."I completely understand the frustration that this has caused, and any fines issued due to the technical issue have already been cancelled.”
