2x Seperate Parking Tickets (I Know!) At Different Stages

Hi Everyone,

I took poor advice of just ignoring these parking tickets but they don't seem to go away as I was told and one is now mentioning court! Not sure if these are just scare tactics or what?

I have completely ignored these up until this point!

I have read through the stickies and am I still at the stage where I am getting in touch with the landowner? Sorry to ask I just didn't want to send any correspondence off and shoot myself in the foot.

Thanks in advance

MA.

The Debt Recovery Plus letter is just debt collector drivel and can be ignored - see NEWBIES FAQ Announcement, fourth post.

The Court Claim Form is REAL and cannot be ignored - see NEWBIES FAQ Announcement, second post.

However, you have left dangerously sensitive information showing on the claim form (claim number and password) where we have seen less than scrupulous parties completing your defence for you, using expletives and personal insults towards the Judge, the parking firm (and anyone else they think fit). You must email MSE and get them to remove it URGENTLY.

(I've also reported, so between us we should get it removed asap).

Your date of claim is 13 May 2022, but have you acknowledged service of the claim yet, if so on what date?  Once you've furnished us with that information, forum regular @KeithP will be along later with some further information for you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Hi Umkomaas,

I have emailed MSE and asked for these to be removed. Thank you for the heads up.

I have not responded in any way to the claim. Should I do this and if so how?

Yes, do the acknowledgment of service (AOS) right away.  That will 'buy' you some further time (33 days from Date of Issue on Claim Form) to produce your Defence. All explained in the NEWBIES FAQ Announcement, second post.

With a Claim Issue Date of 13th May, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 15th June 2022 to file your Defence.

That's three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Hi KeithP,

So am I right in thinking my next steps are:

     1) Requesting a SAR from DPO@ukparkingcontrol.com
     2) Complaining to the landowner (how do I find out who the land owner is? it is on a small retail area with multiple stores but it was outside The Range)

This a standard response I provide to those attempting to determine who a landowner might be.

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information
    7. Contact The Land Registry and for around £3 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.

Yes, those things need doing, but not at the expense of missing your Defence filing deadline.

    Do not miss that deadline.
