Advice please PCN addressed to company secretary ?

    If the car is not registered to a company, it's tempting to return the letter marked no company known at this address. 

    They can do a search if they want to...

    Surprisingly, that's a POFA NTK from CP PLUS.  First I've ever seen from them!

    I think try a complaint to Asda from the Blue Badge holder first.  As previously advised to do first.

    Thank you for your kind advice I really dont need the trash these people peddle. Can anyone tell me if this PCN is POFA compliant ?

    1) it is wrongly addressed (can they re send it ?),

    2) The data for the car model , colour is incomplete - there are no times shown on the notice. The car has three drivers ... so if we go shopping it is possibly driven by more than one person seems odd I know :-)

    3) The car is actually on the line so I dont believe the breach is complete arguably still within the bay ! or not wholly oustide the parking bay.

    I have written to the retail park it is not Asdas land. But if they do not respond in a positive way who can CP Plus sue ? a non existent Co Secretary .... 

    What can they do if ignored ?

    Hi I wrote to the Retail Car Park Centre Manager who ignored my email. 

    We now have a letter addressed to my wife (dont know where they got her name), as the original paper work was addressed to the "Company Secretary" ??? - the letter is from Debt Recovery Plus demanding £170.00 (original Charge was £100.00) ...

    Any advice please on how to proceed ? thank you ...

    BTW we no longer have the car is our possession... 

    Im not bothered I m happy for a day in court to be honest ... as there is little between £170 and £235 which is the maximum they could claim in an "unsuccessful"  defended court case. 

    My main focus is the incorrect nomination on the PCN notice. .... then not over the line etc....

    MP is useless -- spoke to him on other matters ...waste of space.

    First - I am ignoring the DCA

    Secondly - what I need to establish is whether the PCN notice which was sent out late is valid. It was addressed to the "Company Secretary" at this address ... the DCA letter NOW shows the RK of the car at the time. I dont know if this makes a difference, also the parking charge notice fails to identify the time of the alleged breach of contract. I believe that contravenes Schedule 4 of POFA 2012 ??

    As I understand it for the notice to be effective against the RK it needs to show the RK details and amongst others things  the time of the alleged breach of contract.

    No PCN was placed on the car it came weeks later, and does not specify a "time" per se.

    So I need to establish were I am with the PCN and Im not 100 percent sure .... 

    My wife is not well this rubbish is not needed .... so I wish to destroy their case before it starts,

    BTW - Have written to landowner and made a formal complaint as they ignored me when I emailed them ... the guy I mailed blanked me so complained to his boss ... 

    Anyone any advice... ?? thanks

    Write to your MP only in your wife's name (not your name, and use a different email address if you've previously had rubbish responses to your other issues) and talk about her vulnerability.  She should ask him/her to step in on her behalf and write a complaint to the landowner and parking firm (both).

    And read this first (the whole thread) to see how to respond back if the MP gives her a load of crap!
