Advice please PCN addressed to company secretary ?

Good evening,

OH has received a PCN for £100 (£60) if paid now.

The PCN is addressed to "The Company Secretary" at our address. Our home is a private dwelling with no tie to any company. We do not own a business nor is this house linked to any company. Companies house would confirm this.

For security reasons we do not appear on any Electoral Register. The council do have our details.

The car is a leased Motability vehicle, and the PCN relates to being parked outside the parking bay (by one foot) on a retail estate (Chester Broughton).

On the day in question the disabled bays were full. Parked by Asda and the car appears to be over the bay lines struggle getting chair out of the car to be honest.

The event took place 4/4/2022. Letter arrived today.

We were going to bin the letter as it appeared to be a scam thing there is no one here with a tie to any company.

I am not planning on paying these people. if we ignore the PCN what will the PCN company do ? take out a CCJ against the "Company Secretary" who is not named nor is the or indeed any company.

My argument here is that the legal paperwork is incorrect. As the car will registered to Motability the owner and we do not appear on the ER then the paper work is incomplete. I think these people are fishing and this will cost the shops in the retail park more than £60 when we fail to shop there again. 

Can anyone please offer a legal perspective for this issue ? ignore or tackle ?

    Currently it's not legal paperwork - it's simply an invoice for an alleged breach of contract.

    Is the VRM of the vehicle correct on the PCN? As in it's "your" car (albeit being a Motability car). The details on the invoice will likely have been those on the V5C as advised by DVLA. (I think Motability retain the V5C, as they are the owners, but it's the vehicle assignee details that are registered - this sounds like incorrect details have been registered).

    Don't ignore it.

    Complain to Asda Head Office and state that the disabled (wheelchair-using) occupant of the car needed and had a legal/statutory right to a 'reasonable adjustment' (under the Equality Act 2010) of a wider bay.  Hence why the car was parked as it was, in order to get the chair out.

    Odd to get a postal PCN for being parked 'out of bay lines' but it arrived too late to hold the keeper liable.  So as well as complaining to ASDA, appeal as registered keeper, attaching a copy of the Blue Badge but covering the photo.  Repeat the reasonable adjustment/Equality Act argument for the appeal.

    No saying who was driving.

    ParkingEye?  UKPC?  

    Or which PPC?

    The DVLA allows them six months from the alleged parking event to ask for keeper's details.
    Their trade association allows them a further month to send out a Notice to Keeper.

    Which Group Nexus parking firm? Highview or CP PLUS?

    This is especially easy.  It's non-POFA and the NEWBIES thread already explains what this means and names those 2 firms.
