I am glad you sent Group Nexus a LBC, @Apollo14LMP

Did you send it to their registered office or just to their solicitors? I think you have to post a copy to their registered office so it is properly served.

If you are saying this same PCN was cancelled, you might want to ask David at Small Claims Advisor to write and serve a more robust LBC and file a well-pleaded claim for you:

    https://smallclaimsadvisor.co.uk/

He is doing one for another MSE poster whose PCN was pursued to court despite the fact it had been paid at the agreed amount years before.

I am not connected in any way to that business but we know and trust him and he has parking case knowledge most solicitors do not have, and charges far less.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for update. Have you involved your MP in the case?

Did you know that the new Code of Practice has been forced into a temporary state of suspension via two Judicial Reviews funded by the money mountains of some of the sector big-boys who don't like the fact that the Govt has reduced the basic parking charge to £50 (from £100) and the 'debt collection charge' of £70 has been banned. They don't like it, so they're attempting to derail and disrupt things - so the gravy train chugs on for many more months than necessary - kerching!  Your MP might be very important in pressing the DLUHC to resist their move.

The bosses of two debt collection companies are lined up (in positions of influence) with the BPA and are making noises. Read what Stewart Clure (DRP) has to say in the BPA's 'Parking News', linked by @Coupon-mad in the following thread .....

    https://forums.moneysavingexpert.com/discussion/6376216/british-parking-association-parking-news-articles-discussion#latest

...... including his hair-brained conspiracy rant that junior members of staff at the DLUHC added the banning of the debt collection charge to the new CoP in order to create a distraction from 'Partygate' for the Govt. You just couldn't make this stuff up if you tried!
Thank you - I dont use my local MP - He is related to people who own a huge company. I dont vote for him nor really follow him, had some great service from MPs in the past. Some multi millionaire like our MP (and his family) is not someone I would even ask for help . He lives in another world not one that I (or most people) live in - probably side with the parking company or owns shares in them lol.

I believe that these parking companies will frustrate the lowering of the parking fee.

The Judge who agreed that £100 for s PCN was somehow fair again lives in some other world ...

See how my LBC goes and how they react - though I have my own idea already.

The LBC has gone to DR Plus who are the DRC agents for Group Nexus .. Group Nexus have written to me apologetic and cancelled the charge I cannot accuse them of hounding me as of 6/6/22.

Instead the letters come from DR Plus so the LBC has been emailed to them on their website. They are going to sue RK for the PCN lol .. I have a letter cancelling it and have had contact with the landowners too ...  they truly bottled it when I threatened them  with legal action...

I found D R Plus address (registered office) on Companys House as I needed the correct address for service of legal papers.

I will see how they deal with the LBC and may well contact Small Claims Adviser - based on their reaction of D R Plus. D R Plus are the ones hounding for a cancelled PCN which was cancelled near three months ago. Wife worries about them - me well I would have fought them all the way.... disgusting creatures that they are ...

I am just about to look at some case law just out of interest ... Ferguson V British Gas is interesting to me...

Harassment seems to be a good approach not the easiest but I do feel that asking people to even pay  a  PCN and sending court police and council look like letters with all their threats is harassment - the business model is reliant on it !

Hounding someone for a debt which doesnt exist is classed as harassment ...

Oh dear that's wrong. Not served at all; that letter is a nullity.

I'd ask David (posts as bargepole here) by contacting him on his website to see if he will take your case on and send a properly served LBC to Group Nexus.
