Private parking ticket issued on land not owned by the property!

Hi all. Hope everyone is doing well!

I have received multiple tickets on a land that is not owned by the property (C.Court) who issued the ticket! I haven't paid any of them, they use to send debt collection letters and dummy solicitor letters regarding court but they have stopped, today I want to get to the bottom of this as my wife now got a ticket too.

I spoke to the council and was told to appeal using a independent adjudicator and send an email to the crimes department of the council for them to investigate. However, I do not have 10 digit verification number (per POPLA) that should be provided by the private parking firm because they have failed to respond to my emails nor will they provide this reference number over the phone.

I will attach the details with images for advice (HM Land Registry also attached). Nb/ The side of the road I was parked (green dot on evidence image i attached) has no signs nor does it have any road markings, also the entry to the road has no signs too, there are just signs on the side of the road within their land boundary of the apartment blocks (c.court).

The IPC accredited parking agency contacted the property managers which i also tried, they're not responsive. The property managers provided the parking firm with only a google maps salivate image of the location for patrol and decided desultorily on the parking region.

I live on a bus lane so literally no where for me to park, I park on side roads but there are businesses there which deflate my tyres when I park there, on the other side there are houses and they vandalise my vehicle... There's a 24 hour store, car wash and motorbike shop next door so the area is very busy and I rarely can find a spot. I park far away however my father is very ill and I regularly take him to appointments to the hospital so it's very dangerous for me to do this.

We have parked in the side of the road in c.court for over 25 years and never had any issue. Over the last few years the residents of C.court have taken the liberty to put tickets on cars outside their boundary as demonstrated by my images, it's very annoying keep having to deal with these tickets, it should be the property managers responsibility to provide a accurate map of the patrol zone to the IPC regulated parking firm and inform the residents of c.court.

The neighbourhood has changed drastically over the years and its really sad to see. Nb/ I have blurred out details for privacy. Ps. We only have one car in our house.

Your advice will be appreciated, thanks a lot in advance.

Best wishes, Wes

Others will come in with other ideas, but just clarify for me :- who does own where you park, and have you literally parked in the same spot for 25 years without anyone saying anything about it?

It's part of the main road, so the council. It is common ground. Yes indeed we've parked here for 20 plus years with no issues, only the last few years c.court have partnered with a private parking firm and the residents just slap tickets on there willy nilly. I'm sure many people have paid these, it's literally a pyramid scheme.

If you have verified that it is the main road, then you are parking on the public highway. If so, the PPC have no authority to issue tickets. You might want to have some sport with them, or just leave it.

Personally, I would be sending them a 'cease and desist' letter.

Go on... be brave... tell us exactly where this happened.

On the face of it, it looks like private land to me.

    Who is the parking company?

If it's an IPC company as you say, then you'll never get an opportunity to appeal to PoPLA.

Why is that the case for IPC companies?

Is the road adopted, or private?

The third post of the NEWBIES thread explains that.

Hi, I'm not sure what the difference is. The road is not private, it's not owned by any other properties around. Only the house number 825 has right of way. The registry states as follows: The land has the benefit of but is subject to the rights granted by a
Deed dated 12 April 1984 made between (1) House 825 and
    (2) National Counties Building Society, (3) Abbey National
Building Society, (4) The Mayor and Burgesses of the London Borough of XXX. Does right of way mean no parking?

Ps. I'm not blocking anyone's entry or exit by parking on right side of road, nor am I parking in front of a garage.

From what you have written there it looks like that roadway 'C Court' is private land over which the resident of house number 825 has a Right of Way.

If C Court was a public highway, there would be no need for any Right of Way for no. 825.
