    Do you remember getting a message to say that the transaction was void/declined? This could have been an hour after you paid by card.
    Not that i remember if i’m honest, i messaged my bank but they said they couldnt find any attempted payments from the car park.

    i take it the WS can be submitted later on?

    It is believed that these meters are solar powered and work on a 3g or 4g network. Depending on signal or battery strength depends how good or bad they work. The solar power is backed up by battery however the solar power in the UK does not provide sufficient energy and drains the battery. This has proved to be an problem with this type of parking meter even in places like San Francisco. It is likely that this is the cause of the machine failure which has caused many motorists in Lichfield to receive a PCN and in some cases several PCN's. As no tickets are issued there is no proof of payment.

    The Defendant puts the Claimant on strict proof to provide evidence of the strength of the signal at the time and day of the transgression.

    Updated last paragraph.

    Directions for the WS will come from the court. 

    In the WS you will need to show that this car park is a hot spot and drivers are not receiving printed tickets.

    Very disappointing that the new management of Three Spires have appointed Euro Car Parks to replace Excel. 

    I hope that people just stay away from these two car parks altogether and park on a council car park or use public transport.

    Hi folks, so defence statement was sent via email last week, I’ve now received a Notice of Proposed Allocation to the Small Claims Track letter.

    It also includes the mediation ‘pack’ in there too, which i don’t intend on doing.

    It is stating “you must by 18 july 2022 complete the Small Claims Directions Questionnaire (Form N180) and file it with the court office”

    is it just a case of completing that for now, or is there something else i need to be aware of?

    Hi all,

    Back again, its been a while, so since the last correspondence I understand Excel Parking have been removed from management of the car park now under the instruction of the MP of Lichfield, I'd heard nothing for a long time.

    Probably about 2-3 weeks ago I received a letter from the court to say the Claimant needs to pay the court fees by today (13/12/22) completely forgot it'd come round so soon.

    I'd also received a letter from Excel Parking about 1-2 weeks ago basically stating...they believe they have a strong case against me however are willing to settle out of court for a reduce fee of £200.

    To me, this already tells me they're not confident in their case otherwise why would they offer a reduce fee. I ignored this letter, not sure whether that was the right thing to do or not though.

    The court date, if it goes ahead will be 10th Jan 2023
