  • Firstly, thank you to all who have responded so far to this thread with their advice and comments.

    We have now received documentation from the County Court Business Centre in Northampton, where BW Legal on behalf of Premier Parking Solutions claim £248.50. Comprised of amount claimed £163.50, a court fee of £35, plus legal representative's costs £50. An eye watering amount for actually paying the parking fee, parking correctly in a bay AND leaving well before the time expired.

    Our previous correspondence (see previous post) where it was pointed out the parking had been fully paid and and the ticket had printed upon it the error code RR. This resulted in a large wad of documentation from BW Legal which included images of the car park, signage, payment machine and the vehicle entering and leaving within the paid for time.

    The payment machine appears to be a Flowbird, Strada PAL series, payment system. Does anyone happen to have the list of the error codes for the Flowbird, Strada PAL series, payment system?

    Is it best to respond online or post the documentation?

    The block capitals are RR, they are on the same line and read from left to right (Items in Bold are what is printed on the receipt):

    Time of payment 1600     Amount Paid 2.40  then RR

    After the VAT number there is a 6 digit code, printed by dot matrix printer, which appears to be perhaps the transaction code.

    What exactly have you received? 'Documentation' is a bit vague.

    Have you perhaps received a County Court Claim Form, or is it something else that you have received?

    To clarify what has been received from the County Court Business Centre are the following forms:

    N1SDT Claim form (04.14)
    N9SDT Response pack (04.14)
    N9A (SDT) Form of admission (specified amount)(04.14)
    N9B (SDT) Defence and Counterclaim (specified amount)(04.14)
    Issue date 8th April 2022

    Also had a follow up letter on the 19th April 2022 from BW Legal stating erroneously as I have read in other threads:

    "If you defend the claim, the court will then set a hearing date where a judge will then consider both parties' statements and either award a County Court Judgement against you, or dismiss the claim. Such a hearing will result in additional costs and fees being incurred which we would seek to recover from you if we are successful."

    Hope the above clarifies matters.

    With a Claim Issue Date of 8th April, you have until Wednesday 27th April to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 11th May 2022 to file your Defence.
    That's a little over two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    I have submitted the Claim Form via www.moneyclaim.gov.uk

    Claim History

    It informs me that it will be acknowledged during their office hours, which will be tomorrow.

    Now to try and understand the Newbie thread on stating a defence, it is not the easiest information to try to understand from a laymans point of view, but I will crack on and get the deed down soon.

    It is quite clear from reading further that you have in fact filed an Acknowledgment of Service.

    As things progress, clarity is going to be quite important especially when you come to write a Defence and Witness Statement.
