    To be open with you all, I am growing weary of this seemingly never ending grind of what basically boils down to highway robbery, albeit without a firearm...It is an exercise in micromanaging paperwork with tripwires at every step to ensure you make a mistake and they then can steal a wad of money from you. Is this seriously how life should operate in this day and age?

    You will be a good person to respond to the Public Consultation later this year as you have a way with words and a story to tell about how the scam 'works'.

    Now I must spend even more time putting together a defence and ensuring it reaches both the court and those harrassing us before the deadline.

    Thank you for your response. Looking back through the plethora of documentation I have an acknowledment from the court dated xxth May 2022 confirming reciept of our defence. I greatly appreciate you drawing my attention to this.

    My confusion stemmed from them again requesting this in the "Notice of Allocation to the small claims court". My thinking was they were requesting more paperwork,  in bundled, page numbered format,

    Having read a few of the successful hearings, there are matters which I may wish to raise in court to assist in the defence. However I do not wish to place them on this public forum at this time.

    That's the deadline for your Witness Statement and evidence. As explained in the NEWBIES thread, second post, under the red capitals heading: IMPORTANT:  KNOW WHAT HAPPENS WHEN.

    But don't use the RobertCox example there, as it's old (2021 is too old).

    Thank you for your reply once again Coupon-mad, I really appreciate your replies and your kind words, as well as the other folks who spend their valuable time on here. You and the others who contribute, do shine like a beacon in this murkey world of law assisted robbery.

    Back to the matter in hand. My understanding now is I do have to produce a witness statement bundle, is this correct? If so I unfortunately am unable to locate the Witness Statement bundles you mention as the links are to profiles. Searching the website is providing pages upon pages of their posts to sift through. It could be me not understanding how to use this particular forum with its very "unusual" ways. I would quite understand you writing me off as another one of those folks who cannot follow numerous threads, with links to other threads, which again have caveats too numerous to mention, along with their plethora of abbreviations. I am fully open to suggestions on how to sort my act out regards what to do...I just ask that you are gentle with me.

    I would normally keep things to the point and professional but I think the following I need to express. Please read the following not as a go at any of you or this forum, as you have all been brilliant in your help, but my general position at this time and my utter frustration at what has to be done to show I have paid my dues and have not caused anyone harm or loss.

    I currently have 12 tabs open on my computer to do with this hearing, the number of open tabs increases with every page I read.

    I have now paused to reflect upon "why am I doing this?".

    As someone who has had no contact with the law, small claims or parking tickets for that matter, the wall of information I must sift through, comprehend, then put in a "legal format" is somewhat overwhelming.

    I am currently up to my oxters in work, this hearing is having a negative impact on what I should be focussing upon. I have a business to run, added to this my business partner having passed away, the workload is immense. This banditry is taking way more time than I can actually afford.

    I fully appreciate all of you who are assisting me but I simply do not have time to become a lawyer conversant in legalese and the word gaming, in a language which to my mind, is not English as it is normally understood.

     Apologies for the above, this hearing, with having to learn something utterly alien to me, added to my current workload and deadlines is taking its toll. Something has to give.

    That thread has seventeen pages. Easy enough to look through (I've just done it), but to help you out, perhaps start reading on page 9 where the Defendant receives a "Notice of Allocation to the Small Claims Track (Hearing)".

    Hello Fellow Forum Dwellers,
    I trust you are all well. Normal operation is now resumed here, Vlad has had some sleep and I have set aside what time I can to press home with this.
    I've just received in the post a 1cm wad of documentation from BWLegal from a Paralegal I shall not name. This is the day before the deadline to submit the Witness Statement. I have until 4pm tomorrow to submit the Defendents Witness Statement

    Note so far I have only briefly read the wad and below are some of the highlights:
    They have included a great deal of information regards the site, ownership and signage. After a brief reading it boils down to not inputting the VRM and subsequently not paying their penalties. They have added in the region of £1,300 in additional solicitor fees and work to put together the documents...pretty good earner.

    Certain information has no audit trail nor who downloaded or made this or how this was generated. This could have been filtered for all I know. Can such items be construed as evidence in a small claims court?

    As a side note the receipt I produced with the "error code" appears on their transaction report confirming the required fee was paid. Despite me sending a copy to them of this receipt matching their printout they are purely going for me regards breach of contract for lack of VRM. They have not suffered harm nor loss and actually profitted by the vehicle leaving the carpark before the exit time expired. They also did not submit the transaction report to me confirming they had indeed received payment matching this receipt.

    They repeatedly refer to codes of conduct/pratice as if this is some sort of law? They also refer to this claim passing through the hands of District Judge Lacey, then allocating it to the small claims track...stating Judge Lacey was satisfied by its content and the Court should not go behind this order...interesting approach.

    They also state that the defence appears cut and paste from websites containing parking forums..and they state this forum...they then state this has caused them a large volume of work etc. etc.. nosensical defence etc..one asks as a layman, how else does one defend oneself from these predators? Just lay done and accept their demands?

    I don't know how much detail I should go into here on a public forum as has been mentioned elsewhere these highwaymen don't just hang around car parks.

    I shall continue reading and try to make head or tail of where to start.
