    Sorry. I have been meaning to say DCB Legal where I sent my defence. Should I be expecting WS for them? If I haven't received anything yet, does that mean they haven't submitted it yet?

    Wait as long as you dare, without missing the submission deadline, in the hope you will see the claimant's WS before you have to submit yours.

    If the claimant misses the submission deadline, complain to the court and ask for it to be dismissed for filing to comply with the court mandated procedure.

    The WS paras 3 and 4 read well. Are you numbering your exhibits for the judge to find easily? In which case you should give your AST an exhibit reference rather than 'attached as a separate document'.

    I cannot see the deadline that witness statements need to be sent to the court. Make sure you comply even if the claimant or their solicitor fail. If there is time you could wait to see if the claimants WS is sent and then update yours. I wouldn't chase them or remind them of any deadline because if they fail to comply with court directions they could lose by default.

    Alternatively if you are happy with your WS you could send it and later send a Supplementary WS to refute any additional points they make or just prepare to challenge it in court.

    @Not_A_Hope I have numbered the exhibits so will make that change as suggested.

    I have to send in the WS by mid Aug so there is still some time. I was thinking if I was to send it straight away and they see they do not have a case, they might drop it?

    Could sending in a supplementary WS later prove detrimental to my case?

    Judges don't like WS ping pong. My opinion is to wait to see if the claimant's WS arrives in time for you to comment on it before you have to submit yours.
    If they send theirs afterwards, and you see something glaringly obvious, then send a Supplementary WS, otherwise just stick with the one as late as possible.

    Of course.  The year 2012 has nothing to do with your case.  You need to understand and check what you are copying and if there is a typo, it's up to you to spot it and put it right.

    If you are quoting from the BPA Code you must quote from the right one from the right year.
