Napier Court Claim Form

This is from the NEWBIE sticky and there is also a link to it from the standard defence template: -4. After sending off your Defence, the Northampton Business centre will send a copy to the Claimant, and then send a Directions Questionnaire (form N180) to both Claimant and Defendant. You must complete this by the date given, and send it back to Northampton, with a copy to the other side (or their solicitors if they've nominated one as the address for service). The recommended answers to the questions are as follows:
- A1 = NO to mediation (they want the whole amount, you want to pay them nothing, so no scope for mediation. This will not go against you)
- B = fill in all the details, name, address, etc
- C1 = YES to small claims track – this is the limited costs track for claims up to £10,000 in value
- D1 = name of your local County Court – unless you are a Ltd company, the case files will be transferred there
- D2 = NO to expert evidence (this relates to medical negligence cases and suchlike)
- D3 = 1 witness (that’s you) (or more if you are going to get another person to provide a statement)
- D4 = Put down the dates of any pre-booked holidays, NO to interpreter (unless you need one).

No court is involved yet
Read and follow the 12 numbered steps by coupon mad in the defence template post , plus the advice in the newbies FAQ sticky thread near the top of the forum in announcements , especially what was quoted in the above reply by le Kirk
Email is used to send it to the ccbcaq email address , plus to the lawyer ( or claimant if no lawyers are involved ) , unless the claimant has refused email for service , in which case , post a copy instead
Do not send it until your claim history shows that the CCBC have posted the N180 , or until it arrives in the post , so don't send it too early4 -

Ok thank you, I will hold on to DQ until it gets sent.
But referring back to my questions about the defence document (completed as per instructions but I'm not sure about the boxes not mentioned in the instructions)1) The very first box "To be completed by or on behalf of" - Do I put my name or just Defendant?
2) Top right "In The" - Do I put the local county court that I have written in section D?
3) And this last one really is obvious (I think) but just to make sure I'm not misunderstanding anything here - Claim number is the court claim number on paperwork I received?2 -
1. Defendant
2. local court
3. Yes
HTHPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The DQ stage is sent to the CCBC and to the lawyer , the paperwork says so !3 -
Hi guys, it's been a while and I've heard nothing, was wondering if anyone knows if I should have received an email from CCBCAQ@Justice.gov.uk to say they received my defence?
I emailed the defence to them in pdf form 23rd January.I looked online at moneyclaim.gov.uk to see if any record of it was there but it's just showing that I submitted the AOS in December. I didn't do anything else online, just looked to see if the claim gets updated there.1 -
You are sleepwalking into a default Judgment against you.
Tomorrow morning you must send you Defence again to the CCBC. Sent it from your sent folder so that the CCBC can see that you originally sent it earlier. Point out that they appear to have failed to process your Defence properly when it was sent them earlier. Check that you receive an automatic email receipt this time. If you don't get that receipt then phone the CCBC - number on your Claim Form - and chase them.5 -

Some members on here have noticed Gmail failures , sending it does not prove that the CCBC received it , their automatic reply by email does , so maybe try outlook , as soon as you can after 9 am tomorrow when they are open , checking for the email reply thi time , no reply means non receipt AFAIK4
