UKPC County Court Business Claim

Firstly, apologies as Im sure you are sick of these. I have been through the newbies thread & picked up quite a bit of info but nothing that seems to relate to my particular situation. I have received a court claim (issued 13 December) from UKPC issued by DCB Legal Ltd signed by Yasmin Mia relating to a parking fine issued in 2017 which I thought had been resolved. My daughter was living a flat in Maidenhead leased by the company she worked for. I was visiting her & parked in the residents car parking her parking permit. unfortunately, the permit which was only flimsy paper must have fallen off the dashboard overnight (a mistake I have been careful to avoid ever since) so I got a parking ticket. My daughter & somebody at the company rang UKPC & explained that Was legally entitled to park there. I was told that the matter had been dealt with so thought no more about it & now I've received this court claim. Not sure if the person who dealt with it even works for the company now so in a bit of a quandary about how to defend it. My daughter still has the parking pass if that helps.

    Start with the defence template by coupon mad at the top of the forum

    If you are keeper but not the driver , say so in paragraph 2 , if you are both , say so

    Read ten or twenty other defences from this year , to draft 2 and 3 , then post only your adapted paragraphs below for critique , do not post the rest of the template , it is your homework being checked not coupon mads

    The lease , primacy of the contract , plus permission given are the primary Defence points

    Search the forum for "fluttering ticket" defences.  If the PPC cannot provide strong, self-adhesive permits, this is a frustration of contract.  It is almost as if they want the permit to fall off the windscreen/dashboard and create the situation deliberately - a sort of entrapment!

    Yes, we are sick of these stupid claims from DCBL. Judges are  as well, no doubt.

    Bear in mind that UKPC are dragging up these old tickets, must be really hard up now as covid last year meant no tickets in many places.

    Have you sent UKPC a SAR requesting information of the signs.  You are not looking for current signs, UKPC must prove that in 2017 their signs, which creates the contract, clearly showed what DCBL claim.

    If this is another Yasmin Mia pot of rubbish that she signs as a statement of truth, she is claiming DAMAGES ........ this is a DCBL invention and the signs will not say damages in 2017
    DCBL invented this within the last 12 months as in 2017, DCBL were not playing musical chairs in the parking industry.  They seemed to more concentrated on the rubbish TV programme "Can't pay" as they display in their letters, it really is hilarious

    So, get pictures of the signs for 2017 but a big warning...... UKPC were caught doctoring timestamps on pitcures ..... confirmed here

    It therefore does not follow that the pictures they send are correct with a timestamp.
    We have seen a few of these on here ... Photoshop is amazing software

    Are DCBL smart cookies, NO,  they recently cost another parking company called VCS £1000 for a rubbish claim ....... Is Yasmin Mia a real person and why does she sign a statement of truth which is not true, a court judge deserves a full explanation

    Has your daughter complaimed to the MA to get this utter rubbish cancelled.

  • Thank you all so much for the information & offers of help it is greatly appreciated. I have filed the AOS & will work on the defence after Christmas. I may have the original letter that I received with photos so would I still need to send a SAR or should I send one anyway to see if it differs from the original? I just have one question what is the MA? If it refers to management or maintenance of apartments I'm afraid that she no longer lives there she left in 2018.

    Email it anyway , because you require ALL data , not just what you have there !

    MA is managing agent , they are jointly and severally liable due to contracting the parking company , so current residency or not is irrelevant , this is about what happened and by who at the time !
