    Yes , the CCBC will update your claim history when they post the N180

    The n180 only needs to know roughly how many witnesses there could be , so that the court room would be big enough , that's why they ask , 2 or 3 would be a small room , 20 may be a much bigger room , as would a hundred ! Remote hearings don't need to book a room

    No documentation is submitted to the CCBC or claimant with the DQ , save it for later

    It's not only the size of the room... the court also needs to consider the time allocated.
    It may well take a little longer to hear the testimony of one hundred witnesses.   ;)

    Thanks Keith I've read through these a few times they are very useful but I couldn't see anything about whether they update MCOL when they post it unless I missed it somewhere. Also do witnesses have to appear in person or can they send a statement?

    Yes, the CCBC will update your MCOL Claim History when they send you a Directions Questionnaire. I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course.

    These days usually no-one has to appear 'in person'. Most hearings will be via telephone or video link.

    It is not recommended that you allow a hearing to be decided 'on the papers' - if that's what you mean by your last question. A litigant in person will be at a distinct disadvantage against a professional advocate in such a situation.
  • Thanks Keith. No I wasn't referring to a hearing decided by papers I know that is a definite no no! Sorry not making myself very clear - maybe because I'm not clear! What I'm trying to find out is whether the managing agents at the time are a witness or just part of my defence & witness statement which is why I asked if I need to add them as a witness on the DQ & whether they need to attend. Sorry for the confusion.

    If they are willing they can be all of them , or some of them , or none

    It would have more credence if a witness turned up , could be questioned , than only submit a signed statement , so it looks better in court if a witness attends and backs up their WS in person

    However , those stages won't happen for months , you are at the DQ stage , so just put an assumed small number , a number which is the maximum for your side , say 2 or 3 ?

    The MA are not going to attend and the Judge won't order them to, so the witness is just you.
