Highview Parking after 4 years send a claim form

    This is interesting.  I wonder what the trigger is for this possible change?

    It's already law - passed in 2019, pre-COVID - and the actual Code and framework is just being finalised, according to replies to questions in Parliament:

  • Hi folks - hope you're keeping safe in this wind and there's no damage to your property.

    I have received the DQ and am ready to complete one to send one back as per advice.  The deadline is for it to be with them by 28 February.  Is there anything to be gained/lost by either completing asap or leaving it closer to the day?

    The covering letter of the DQ they sent to me, includes a part that has been crossed out - see attached.  I presume this is standard as I'm the defendant and nothing new?

    All perfectly normal - it's a standard letter that has been edited in respect of the recipient of that copy. :) (Sometimes they forget to edit).

    No real reason to delay completing and emailing in your own DQ - there's no benefit nor deficit in waiting.

    i am concerned you missed the great news in February about the new statutory Code of Practice, which was published and is very useful.  You need to know about it.

    I've created a new paragraph 4 onwards to replace the template defence:

    Showing you and others, even though your defence is in and you are at a later stage, because it should be fairly easy to adapt and use in witness statements.

    Debt recovery 'cost/fees' are now banned from being added to parking charges, and that new wording explains to a Judge why that is relevant for existing cases, too.

    Also read the whole new DLUHC Code of Practice because it covers all the ususl points and issues, and states the best practice position.

    Not retrospective but you can use it in a WS to effectively say 'Here's what a professional parking firm should have done'.

    I'm pleased to say Highview have dropped the claim and are not taking this to court. It was due to be heard in court in January with attendance optional but they pulled out.

    So a massive thank you to you all for your assistance.  
    Did the notification of their discontinuation come directly from Highview or via DCB Legal please?

    This would come from DCBL so as Umkomaas has asked ....... was this a discontinuation letter
