Highview Parking after 4 years send a claim form

In January 2017, I overstayed the specified time at a car park run by Highview. I followed the then advice here and elsewhere and ignored the letters (edit - apologies for this, it's clear the advice here was not to ignore the letters - I think I got that elsewhere. Sorry for the incorrect comment)

Over four years on and I've received a claim form from them. There's no covering letter, just the claim form and the response pack.

Do I now need to respond or is this a scare tactic? 

As per the attached, the total amount of fine is £277.41

    The then advice on here was as follows ( and has been since march 2013 when I came here looking for advice )

    Do not ignore a PCN , or an NTK PCN , appeal it using the blue text template by coupon mad in the newbies FAQ sticky thread near the top of the forum in announcements , so you made a bad mistake by ignoring the NTK PCN instead of appealing as keeper like everybody else !!

    If you ignore this Claim form pack from the CCBC in Northampton , you will obtain a default CCJ due to no action taken !! Is that what you want ? Its a live court claim , foolish to ignore it !! I wouldn't !

    You need to read the fifth post and then the second post in the newbies FAQ sticky thread near the top of the forum in announcements , following the Court claim advice in there , read it several times before doing anything

     the issue date is 27th Nov 2021 , Do not complete the AOS online until Thursday or Friday this week

    Email a SAR to the DPO at Group Nexus attaching a copy of the claim form as proof of I D under the GDPR law to obtain all your data , also attach copies of 2 recent redacted utility bills too



  • Thank you.  I definitely do not want a CCJ.  I'll start reading the comments you recommend and will follow advice.

    Is it likely that I'll have to pay all of the amount?
  • Also, at the time of parking, my name was incorrect with the DVLA (first name was spelt wrong). This has since been corrected. Is this likely to cause me a further problem?

    Thank you for the advice. I'm rather worried.

    The chances are that if you lose in court , for a single PCN , you would pay about £200 within one month of the hearing , to avoid the registering of a CCJ , so a Grace period to pay in full and rectify matters , then it's done and dusted

    If you win , you pay nothing at all

    No , you can correct it when you submit the AOS , 5 or more days after the issue date , if the claim form has incorrect details. If the claim form has your correct name and address , then the previous mistake is irrelevant

    Oh dear, as @Redx says, ignoring was not the advice here and in 2017 we were laughing about how easy it is to appeal a Highview one.  Their PCNs fell like flies and the quickest cancellation from our template appeal was within 2 hours flat.

    Such a shame that people didn't come here and see their PCNs off with one email, and now we see stupid pointless claims that some who wrongly ignored are having to defend.

    Just copy all the other Highview defences.  We had a shedload in May and June.  No links, spend a week researching.  Perfectly winnable and no CCJ or costs risk as long as you follow our advice and all court Directions.

    I read that it's heard at the local court - so just to check, does that mean it may well not be Northampton and somewhere closer to me?  Northampton being over 100 miles away.

    It's never Northampton unless you live in that area ? Which you don't ! It's not a county court either , it's a government office like the DVLA ! No idea why you think it's a court or why you think you would travel there !

    My local court is Manchester civil court ( or maybe Stockport ) , so I would choose one of those 2 

    If you were in Leeds or Newcastle or Liverpool , you would choose the nearest one to you , using Court finder in Google search , so do so , look for your nearest Civil court ( not Magistrates , but Civil )
