UPDATE: PE cashed the cheque today... waiting for any feedback from ASDA1

OK and issue a claim 10 days before Xmas if they don't. Make sure you word the POC with a proper legal basis for why they owe you the money (breach of contract - a promise. Dates, details, amount).

The Parking Charge has been cancelled and a refund payment will be issued to you by
cheque in the post.
We will endeavour to provide your refund as soon as possible, however on some
occasions, due to high volume of correspondence, this could take up to 40 days.

Today ASDA contacted my for the SAR request (after exactly 30 days):"Unfortunately, we are not able to provide you with the information you have requested at this moment in time. This is because, during the course of collating this information for you, we have found that the email address you have used to contact us does not match the email address we hold on the Customer Service Record relating to the correspondence you have had with us. "They are clearly lying as I, upon checking my emails, I can confirm I always used the same email (as specified in the SAR) to contact ASDA, and in most communications (if not all) i used also the ref. ... (parking ticket reference) and my car registration ..., so they should be able to locate my emails and phone calls without problems.Should I reply something like "If you cannot find / provide them, I will consider this a breach of the Data Protection Act 2018 (loss of personal information and/or not able to provide them upon request. The written correspondence and phone recordings I got can be used as evidence to support this."Any idea how to take the matter forward?thanks!

yes, it worked well! The sad thing is that without determination, lots of time and valid suggestions (thanks!) most people would prefer not to fight a ticket and would just pay the initial discounted charge - I am sure PE are counting on this.
The 40 days time required for a cheque is really a joke, I guess this is the maximum time they need, but they should definitely taking off somebody the issuing of PCNs. The only reason I will just wait for the cheque is that it is impossible to contact them without having to go to the post office. I wonder how they can get legally away with it - surely facilitating customer support should be legally required? or not?
This weekend I will draft a nice email for the SAR team - another joke!

Asda has learned a hard lesson and that is customers must come first. Let's hopr they realise that whatever parking company they employ, they must retain complete control at all times.
I would now send an invoice to Asda for your time spent and of course you will acept vouchers.

I would now send an invoice to Asda for your time spent and of course you will acept vouchers.I used to work for a company that is the biggest in the world in it's sector, they worked on the policy that keeping money in the bank for as long as possible gave them more return, they tried paying our suppliers on a 90 day turn around, but insisted on payments to them within 28 days.They also used to issue cheques from a bank that had the longest payment period and send them 2nd class last thing Friday to hold on to the money for as long as possible, believe me this is a nasty way to act and if I told you who the ruthless ****** are you would be surprised.3
