    Unusually, I think paying PE then pursuing Asda for causing you that loss would be a good move in your specific case.

    Was this a £70 PCN discounted to £40 for payment within 14 days? If yes then there's no early discount still available so the cost is £70 ... which may rise further (for no reason other than debt recovery), although I don't know if PE are one of the few companies who don't subscribe to that unlawful nonsense given that they were the other party in the Beavis case.

    Edit: I'm not sure writing a "payment in dispute" notice when paying PE matters at all, if it will be ASDA that you raise a claim against. It certainly doesn't hurt though.

    If you think that no money is owed, why are you paying them,?  Why not challenge them to take you to court?

    I would be putting Parking Eye on notice of what happened and that you will now sue their client for the money back. What you have drafted there is meaningless to them but saying you will sue their retail client and proving intent, will give more clout.

    What I would do is prepare a LBC to Asda and attach a copy of it for PE to read as well as actually posting a copy to Asda.

    Give both, say, 21 days to respond as you don't have to abide by the PAP, as such.  Encourage PE to return your cheque and cancel the PCN or you will litigate against Asda for promising to cancel it.

    Don't send 'signed for' but obviously get free proof of posting both.
