I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

ASDA came back to me today "Asda will not and should not advise out customers to use POPLA as this is something we advise against and should only be used as a last resort. We haven't had any issues with Parking Eye cancelling at our request before so I am unsure who you spoke to. Unfortunately as this has been sent to POPLA there isn't anything we can do as their decision is final. "
Now, I am going to send out a SAR to get details of the communications with me (by email, phone) and with ParkingEye in relation to my ticket with my name. The idea is to collect some hard evidence.
It seems like I will have to pay ParkingEye, but take action against ASDA for negligence.
Any suggestions / other ideas?
thanks!0 -
PoPLA are an unregulated body wholly funded by parking companies. It is not independent. A PoPLA decision is not binding on the motorist, so it is not final, and it costs the parking company nothing up front. They don't have to take it to PoPLA, and even if they do, they can pull out without paying if they want to do so before it goes inm front of an assessor.
Since there is no cost to ParkingEye at the moment, there is no reason why ASDA cannot instruct PE to cancel.
Complain again to the store manager and CEO. Show receipts/redacted bank statements to show how much money they will be using from you if they don't cancel because neither you nor any family members will shop there again.
Contact local and national press, leave negative feedback on ASDA'sr website as a warning to other motorists, complain to your MP, shop elsewhere.

A Popla decision is neither final nor binding. Reply telling them so and tell them that, if this goes to court, you will be seeking their attendance. You never know how far you can go until you go too far.1

thanks again.
I have just sent a strong communication to ASDA with the suggestions provided on this forum. I have also sent a separate SAR to collate all relevant information together.
I will keep you posted!3 -
So Asda are saying they actively 'advise' consumers NOT to use the only appeals service open to them, except as a 'last resort'.
Ask who has told them to 'advise' the public not to use ADR, surely not ParkingEye?!Do you know what, that's not going to look good on Asda giving people such 'advice' (their word). Your case exposes ASDA actively causing consumers to miss POPLA deadlines, whilst Asda sit in their hands and allegedly 'forget' to send a cancellation email that would have been 'final'.
But time is not on the side of a motorist. Asda's advice is dangerous and will cause loss in a case where they fail to cancel the PCN. The motorist/keeper has no chance of waiting and using POPLA as a 'last resort' because of the way the system 'works'. ParkingEye rejected the first appeal and gave a one month time-limited POPLA code. M
That deadline had to be met, but had ASDA kept their promise and sent the piddling little cancellation email they promised, ParkingEye would have offered 'no contest' at POPLA and saved the cost and all would have been well, no-one's time or money wasted.
From what you have said, ASDA have caused this and are digging an even bigger hole with their replies. Tell them the above.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

POPLA is just an unregulated joke along with the joke of the BPA
The clue is that ASDA are just smal fry in the world of supermarkets, if they want to be stupid ... and send you off to other outlets, that is their problem.

Asda are very ignorant about such matters.
I disagree, Asda heve cancelled three tickets for me recently in very short order. Each ticket was for an oversytay. You never know how far you can go until you go too far.0 -
