    Sorry mate. Have been looking through it for days now and couldn’t find what to do. Honestly not being lazy here. Apologies. 

    Edit. My phone was opening the last page of the defence template thread and I couldn’t find it on the newbies thread apart from the “DQ - an easy form” with link of what to fill out. 

    Not sure why my phone takes me to page 14 of the defence template thread with no way of going to the first page. Just back clicked through each page one by one to find the list I was originally following (but had forgotten where it was). 

    Anyway, sorry for wasting your time but genuinely couldn’t find what you were referring to. Will crack on with the steps now. Cheers and hope you all had a great new year!

    if you have already viewed a thread, the forum add latest to the weblink and takes you to where you last viewed it, so I get the last page on that thread too, so you scroll down until you see page numbers and click page 1 , then view post number 1 , the first post , so the first post on page 1 of that thread ( discussion )

    but as mentioned earlier, not on a phone , ideally use a laptop or desktop pc, phones etc give you a cut down version of the internet, not the full monty

    now you login to MCOL every now and again , firstly to check its been logged, then to see any progress, UNTIL they send the whole bundle to your local nominated court, at which point they step out of the ring , no further action by them, they leave it to your local court

    Hi Guys,

    So i have been a set a court date for the 12th of April, i was hoping the PPC would have abandoned the case by now but no such luck! Very nervous right now..

    The court paperwork is suggesting that parties are encouraged to settle the case by negotiation and contact each other. It goes on to say that all documents must be delivered to all parties and the court no later than 14 days before the hearing.  The court requires a hard copy of the documents by post or personally delivered.

    I will use the witness statement by robertcox as noted in the newbies thread to try and formulate my own. 

    I was hoping the PPC would have seen my information so far and stopped the case from getting to the court. Am i right to be worried that they are willing to go the whole way?

    There are more recent, better examples which we now recommend to be used. Check out those by @nosy and @jrhys

    It's a juggernaut, just ploughing on. No human is much involved at this stage. You have to continue playing the game, they are just waiting for a slip up on your part.  Keep going and see what happens. There's nothing else you can do (other than pay the current outlandish charge) to halt proceedings now.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Not the best at talking in public at all. Their solicitor will be very used to doing this. Probably best not to think about it and get on with the witness statement.

    Yes it states that the Deputy District Judge Fawcett has considered the statements of the case and DQ and allocated the claim to small claims track.  Goes on to say that it will be in person at the Birmingham Civil Justice Centre, for a Dispute Resolution Hearing before a District Judge it states.  It goes on to say that the hearing will last around 30 minutes. Parties are encouraged to settle by negotiation or narrow the issues.  

    It doesnt say anything about video or telephone, which i probably would have preferred.

    So does this still require a full witness statement? I would have much preferred to have had the proper hearing as being a full time unpaid carer i will have to organise someone else to come and take over my care duties. It seems a waste of time if all im going there to say is i want a hearing.

    Yes, kill it with a humdinger of a WS and evidence bundle.  You can't change it later so throw the whole lot in and hope the Judge decides your bundle is better snd gives THEM a hard time.

    Bear in mind the Judge does have the power to decide a case there and then to avoid a further hearing. So put your heart & soul into it but be ready for a clueless Deputy Judge who wants Defendants to shut up and go away.  If that is how it goes, just be very clear: no!  You want a hearing.
