  • So the hearing is Thursday and not sure if it's on. Did not hear from their Solicitors or got details from the Court for the conf call...any thoughts?

    What does your notice of allocation say about arrangements for/before the hearing?  Is it definitely a conference call?  If so, they should have asked for your telephonic details.

    Claim has been dismissed. Judge made no order for costs (no reimbursement). Claimant did not attend.
    Good outcome. Could you give us a bit of what was said by the Judge please?

  • sure he really focused on the fact there was a JustPark nearby where I could have paid BUT the claimant did not advertise it. He read the Claimant WS out loud in the relevant parts for the record. He asked me for my side of the story. I said I would lay out the facts and add my comments if he was willing to hear them. He heard me out with patience, I explained what was in my WS https://www.dropbox.com/recents?_tk=web_left_nav_bar&preview=WS+IPC+v6.pdf&role=personal that I summarised via my Crib sheet. The comments were about the process being time-consuming and these companies probably making good revenues from this stream of business, but no one knows as they are private businesses. He listened to all my comments as well. He then summarised everything at the end and asked me why I should receive money for my invested time. I underlined that it is a lot of work and stress to win these claims, the stress I did not monetarily account for. That did not soften his position and decided not to award me anything. I wonder now if I can somehow recoup some of my costs, he said that because it was a Small claim he did not / it was not contemplated. My opinion is that a process like this that lasted 3 years and does not imply any form of compensation is too favourable for the Claimant. In total honesty, I left a bit gutted to do all this work for nothing. In hindsight, I think most people would pay the fine and that is not OK because it basically justifies the Claimants procedures! Let me know if you have any more questions happy to share! Thanks again for all the precious help from all of you. I am happy the Claim has been dismissed and I have all of you to thank for it. Needless to say, not in a million years would I have made this on my own. Not a chance.
