DCBlegal letter of claim

Hi

I received a letter of claim giving me 30 days to respond from a parking ticket with CP Plus whereby the original invoice was sent to an old address. I didn't know I had a ticket until the letter of claim which has come to my current address. DCBLegal have sent the letter of claim and the parking ticket is from 03/03/17.

I looked at my previous bank statements to see where I was and what I bought on that day and it shows 2 trips to the same Macdonalds on this land. So they had me going in and going out on one time only but there were two separate trips. I can now kind of recall the day due to other payments from my bank account that day.

Anyway, since DCBlegal have my current address, I'm assuming that the County Court claim will be from this current address and not sent to my old address! However, what are the chances they send it to my old address? I don't want to end up with a CCJ because it feels a bit sneaky.

What's the best thing to do, the 30 days started from 26th July 2021.

2017, I mean why wait this long to do this. I just successfully got rid of one case with Burger King but I knew I had that one.

@JustBee - please start a new thread as your case is on track towards a court hearing. 

Send a 'data rectification' notification to the DPO of CP Plus telling them to 'erase' (use that word) your old address and replace with new one. Tell them to notify all agents with whom they have shared your data to do likewise. Otherwise you risk a claim going to your old address, you being blissfully unaware, until you check your credit rating and you realise you have a CCJ that has the potential to blight your life for the next 6 years.

Because they can - they have 6 years - and COVID-19 has destroyed their income lines, they need sustenance!


Excuse my ignorance but what does DPO stand for and would you email the notification? I can only find an email on their website that I'd be able to correspond with them, the rest is to pay or appeal and neither give options to add information etc. Would you ask to see the original parking invoice as I've looked at my bank statements again and it looks like I was looking at the 03/03/17 and I've just realised the invoice was for the 13/03/17. Going off my bank statements for that day I was in another town completely!

    Acronyms are in the fifth post in the newbies FAQ sticky thread near the top of the forum , all companies have a DPO since GDPR came on a few years ago , yes , email the data rectification notice to the DPO , then email a SAR to the DPO too

    The SAR reply should contain all your data including all documents !!

    After doing the above , tell dcb legal to place the matter on hold for 30 days whilst you seek debt management advice

    Then gather all your evidence for the impending court claim

    DPO is "data protection officer" who is legally required  to provide the information they hold on you .... that is CP PLUS

    Now DCBL, we see on a regular basis they don't have a clue what they are clamng for ?
    Such old claims DO NOT work in the courts

    1: You wait until day 27 and then tell DCBL you deny any debt and that you require a further 30 days as you are seeking debt advice.    THAT IS THE LAW

    2: You include the proof as you say. You include a costs schedule you will claim against them 
    Normally £20/30 above their claim.  

    3: Then wait

    When I look at GroupNexus' privacy policy - there's a link to their Privacy Policy from their homepage - I can see the email address for their Data Protection Officer.

    Did you check their privacy page ?? All companies are required to have one setting out data protection policies and it's most definitely listed , like KeithP said above

    Your email goes directly to the DPO , not via Timbuctoo 😜😜😜

    This is called double dipping, it happens when ANPR cameras malfunction.  They are sufficiently unreliable as to be banned in local authority car arks.

    Have followed instructions and sent SAR to One Parking Solution. 
    Some questions :
    1) How many minutes "grace" do you have before getting walloped with a fine? 
    2) If car park is full how long are you reasonably allowed to wait for a space to become free? 
    Basically driver parked outside a bay as car park was full. Went in to get cash from bank machine. Whole episode took six minutes. 
    Never received initial letter or response to emails. Wish I had found this site earlier!

    1) download and read the BPA CoP and the IPC CoP , the parking companies are using the relevant CoP , so it's one or the other as required by their memberships , SO knowing which AOS they are in matters as far as grace periods , but assume 5 minutes if parking is allowed

    It's not a fine , it's an invoice for breach of contract , completely different

    2) There is no reasonable period defined in law , but again it's the grace periods which cover it in the relevant CoP , or as defined on the signs if greater

    So I emailed a copy of my V5C on Friday 13th and haven't heard back from them yet. They sent me their form to fill in which I've ignored. They said they can't go ahead and the 30 days won't start until they get proof of who I am.
