Government Consultation re private parking charge levels, August 2021

"CAB advice for private parking charges has been woeful all along. They almost always recommend paying to avoid further action. They don't understand the issue. "
I am sure that you are right but it is so wrong when you think of all the claims that have been paid that we don't even see on here. Many of the posters to this board get the fake add on knocked out by either the PCN being cancelled or at court. It's all the rest that are unaware.

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Martin Lewis could do more to create awareness on how to avoid getting a PCN in the first place. Prevention is after all better than cure.

The vast majority of people will be unware that they are being asked to pay a fake amount ?
That is where a claim back system will come into operation.
I would invite the BPA and IPC to make clear their legal authority to tell PPC's they can add a fake amount. We know the person within the BPA who dreamed up this extra way to make more profit and this may well come back to bite them
An answer from the BPA would be good as they operate in an unregulated business and use an unregulated code of practice2 -
Can I suggest that arguing about the merits or otherwise of the CAB advice, or Martin Lewis's advice, is not going to butter any parsnips.
The deadline for consultation responses is midday next Friday, 27 August - 10 days from now.
Everyone should be getting their family members, friends, work colleagues, servants and tennis partners to respond to the consultation, and in particular Question 12 about so-called debt recovery charges.
The message to MHCLG must be a big fat NO - this is unlawful, unfair, and goes completely against the original intention of Sir Greg Knight's private members' Bill.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.5 -

I have now seen a lot of MP replies from my colleagues and my guess is that there are going to be a lot of unhappy bunnies in the parking industry3 -
I suppose Sir Greg is up to speed on this, has anyone heard from him?You never know how far you can go until you go too far.1

Same as Pete Wishart in Scotland, it was confirmed. Plus of course Mrs May who is looking into this.
In time, we will see the results5
