@Rodent3768 I have since had a shoddy response, same situation with Land Owner giving no permission and it was on a listing building so I've directed them to the criminal offences act for listed buildings and other heritage sites to represent Autosec if they keep pushing further.Doubt they even correspond past the initial PCN passed along. Professional harassment and scumbags.3

Rodent3768 said:Further to our emails in respect of the above, we can confirm as follows.
The freehold of the land on which your car was parked is owned by our client and previously formed part of the lease to The Shaw Trust. Since they vacated the premises, there has been no agreement (as far as we are aware) during the remaining term, and certainly none with the freeholder, for any car park monitoring or ticketing service on this land.
The copy of the PCN provided is illegal as the company "Autosec" had no legal right to issue permits or indeed prevent anyone from parking on that land at that time.0 -

I've been some general browsing and had a look at the DCB Legal website about Parking Tickets (https://dcblegal.co.uk/parking-charges/) and it was nice to see how they follow the law. CCJ straight away! I don't think so Mr DCB Legal! I've let the SRA know of their scaremongering.

Technically they're not wrong ... if you lose the case then a judgment is entered. You can prevent it being registered if you pay within the defined period.Jenni x4

Thank you‘Autosec support team’!??? That’s a joke. The company has zero employees!
Autosec support team.Dear Autosec,Let's see what happens.
I would like to draw your attention to my rights under the Data Protection Act 2018 and General Data Protection Regulations (GDPR)
Please supply the data about me and the vehicle that I am entitled to under data protection law.
You must include:
- All photos taken
- All letters/emails sent and received
- Full copies of the PCN and NTK
- A list of all PCNs outstanding against this VRN
I do not have to access any documents through your website.
Any images on the website are not the whole case file either. I am aware that you have letters and emails I have sent to you and there must be communication relating to the VRN that has gone to Debt Collection Agencies. I require copies of all this correspondence. If you do not have these documents how would DCB Legal know who to issue the claim against?
If you are unwilling or unable to send me this information, either electronically or physically, I will consider contacting the Information Commissioners Office to report you for breaching the legislation.
If this does proceed to the small claims court I will seek damages from yourself when I prove your claim to be illegal and a waste of the court's time. You may wish to review the letters you have from me which explain why.
However, you can avoid all this if you cancel the PCNs and instruct DCB Legal to cease and desist any legal proceedings.
I await your response and remind you that the legislation requires you to provide the information in one calendar month (19 August 2021)
Yours sincerely
Mr Rodent
I'm giving it a couple of days before I instruct DCB Legal that I'm seeking Debt Advice.2 -

OK, so BPA have completed their investigation into them not having authority to issue notices on the site the vehicle was on. Their response is below.Dear Mr RodentBPA reference: BPA-
Parking Charge Notice:
Thank you for your patience whilst we have conducted our investigation. As you are aware Autosec are no longer BPA AOS members and they are no longer bound by our code of practice and this has presented a challenge to us in conducting this investigation. We have however made some enquiries and we have spoken to their legal representatives who have provided assurances to us that the consents are in place. The matter will now need to be determined by a judge in court or ahead of court if you are able to reach a resolution with them.I appreciate this may not have been the response you might have hoped for, I regret I am unable to assist you further and this case is now closed. I would suggest that if you wish to contest the charge further that you seek legal advice.I hope the above is helpful.Kind regardsSara RobertsHead of Approved Operator Scheme
Let's see what DCB Legal and AutoSec come up with now! I would be interested to see what their assurances were. Perhaps I should ask the BPA? Was is a contract.....? Or more likely a very indignant... 'Yes we have!' (With a stamping of feet)4
