    We try to be realistic with the advice we offer. You'd possibly want to pursue your case under the legal doctrine of 'Ex Turpi Causa Non Oritur Actio', but it's one thing shouting about it to 'willing ears' on a parking forum, quite a different kettle of fish in court where PPCs, when in danger of something potentially nasty coming their way, will have no qualms in turning to the services of a very expensive silk - then you will have to have all your ducks in a row, and each feather in its right place!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    LBC isnt in place
    i have emails from planning enforcement advising signs were to be removed
    PPC/landowner ignored so council have issued enforcement notice

    DCBL are a huge liability to themselves. They are so hooked on robo claims, they know nothing about

    With the info you have. a judge is going to wreck them and then you must complain to the SRA
    My barrister has a letter ready for the SRA ...... it does not make good reading

    There's no LBC consent involved in this thread's circumstances. At the moment DCB Legal are following AutoSec's faulty instructions. They've been told that there is no leg for them to stand on. If they have any sense they will advise AutoSec to crawl back under their rock

    Right up to the end of last year a large number of Autosec contracts were verbal contracts (I  believe one of the parties to these verbal contracts has now retired) verbal permission was granted to erect a sign and keep proceeds from parking infringements, and that is it... 
    BPA rules insist on written contracts therefore therefore their membership at the time is also questionable (I believe they are no longer members of the BPA now) 
    Autosec only had written permission to take legal action from late December 2020 and that was probably triggered by Baysentry Ltd who purchased Autosecs parking business during this year
    I'd expect no less from Delgrosso and Autosec but fact that DCBL are aware of this and are still continuing to take money from unsuspecting motorists is beyond dishonest

    part of my ignored challenge to Autosec in Feb 2018 was to produce copy of contract with landowner and evidence the LBC was granted - that's probably why he ignored it

    Now there is an important task to do in August: 

    The final Government Consultation into the level of parking charges, discounts, false ‘debt recovery add-ons’ (that no PPC actually pays)...

    ...and the Appeals Charter - that should IMHO result in full cancellations not enrich the PPCs by £20 or more because it would just encourage spurious PCNs that should never be issued...

    Please tell your family and friends to encourage colleagues who have had these spurious PCNs and claims to email their evidence to the MHCLG as shown in the Consultation and not just do the tick boxes. 

    The Government want evidence - victims must give it to them.  DON’T MISS IT.

    @hullensien mine was on a listed building aswell in the center of Hull. dcblegal still have not responded yet to the SAR. The 6 year mark is December, how would you time this out, does 30 days become applicable everytime I respond?
