Autosec and DCBL Letter of Claim

    Nothing apart from Letter of Claim and automated email from one I sent them.

    DCBL have come back asking for my Address and Postcode as I've asked them to supply the information as AutoSec aren't.

    I'm intending on waiting a week or so then following up with this:


    Dear Sir/Madam,
     
    I acknowledge receipt of your ‘Letter of Claim’ but have concerns that it does not meet the Pre-Action Protocols for Debt Claims.
     
    To enable me to assess the claim fully could you provide the following:
     
    ·         Clarification whether I am being pursued as the driver or the keeper.
    ·         Breakdown of the alleged debt.
    ·         What is the true interest rate rather than an unknown base rate + 8%?
    ·         What were the terms and conditions of parking?
    ·         Please supply a Reply Form.
    ·         Please supply an Information Sheet.
    ·         Please supply a Financial Statement Form.
    ·         A full copy of the PCN (Autosec have only directed me at the payment portal which does not have full details and guidance).
    ·         All photographs of the vehicle.
    ·         Photographs of the signs.
    ·         All letters, emails, other correspondence and data transfer files relating to Mr Rodent of the above address, PCN Reference 123456 and Vehicle R0D3NT.
    ·         A site plan of where the alleged incident took place.
    ·         A copy of the signed contract between AutoSec and the land owners/occupiers.
    ·         Confirmation that this is the only PCN which will be pursued

    Once I have received the above information I will respond fully.

    I'm not expecting miracles but it would be nice. Does anybody have any further suggestions?

    I am also in the same boat here, I have sent the Subject Access Request to them and received the same response. I have since sent one on to DCB Legal. I'll update if I get anywhere. Funny thing is I sent an e-mail showing my permit back in 2015 to them for the 3 PCN's and no response, yet now they respond to this within 1 day

    Dear Ouroboros21,

    Subject access : 

    Autosec issued the three parking charge notices you refer to the same vehicle which you haven’t stated the registration for nor shown that you have any relationship to, for instance you may be the Keeper of.

    Having said that as Autosec does not hold any information about yourself and we can ask you to go to :

    payautosec.co.uk

    Input your registration number and then one by one input the three reference numbers.
    You will then see all information Autosec holds about each PCN, additionally this vehicle has a fourth PCN ****** for which we will ask our debt collection company to pursue also, therefore you may wish to review and copy this information also.

    For the avoidance of doubt once 28 days has elapsed since the issuance of a PCN without payment, the information you can now see at payautosec.co.uk is automatically electronically passed directly to debt collectors whom contact the DVLA and subsequently write to the Keeper (NTK) and pursue the matter ultimately to County Court.

    Autosec does not have sight of this as we leave the matter with the debt collection firm after day 28.
    Therefore we have shown you how to access all the information  Autosec has and ask you from now on to only contact the debt collection company who are in contact with you.

    The details on the site are not a full PCN so I don't know what they expect to achieve if they can't produce a complete record.
  • @hullensien mine was also a residents carpark in Hull formerly managed by AUTOSEC

    Mass attempt at money grab? Let's see if these go anywhere because I can prove I lived at the residence (I have also requested a council tax bill for this time period)

    If Autosec do not have the information, how did they manage to instruct DCBL ??

    Or, have DCBL been stupid enough to think that a debt collector can bring the claim ??

    Autosec seems to be a big liability for DCBL

    OR, have Autosec sold the debt to the debt collector ..... which is not alowed

    It's bounced from Autosec to TNC to DCBL to DCB Legal. That's why I'll be asking for data files as well. They've shattered the DPA somewhere along the line surely.

    regardless of the game of musical chairs these people play, If Autosec instructed DCBL, they have the information you require in your SAR

    DCB Legal have accepted my email as a SAR so will see what comes out of that. Also have a lead that AutoSec didn't have authority to ticket on the land which I'm following through on. Still might not be possible to drag it out 2 more years.
