@Umkomaas seems pointless asking for costs if they never allow them? Don’t want to rub the judge up the wrong way.I’m still fascinated that it’s acceptable to be £255 out of pocket because they can’t be bothered to do a soft search, despite there being 12+ months between the alleged incident and claim. What’s the point in having the rules when they don’t follow them and get away with it anyway!0

Olive_j said:Thank you, @Umkomaas. I have until 4pm Tuesday to submit. I wanted to send it and get it over and done with, but does sending it tomorrow give them time to read/respond in their own witness statement to the points I’ve raised? Please note, we are not a legal advice forum. I didn’t say they never allow costs. They rarely allow extra costs for unreasonableness. That’s two different things and neither of them are ‘never’ awarded.Given how much this has cost you why would you not ask? What’s the worst that can happen; Judge says no. Maybe Judge says yes...given you have a long list of unreasonable conduct.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Of course you should ask for your costs, you were dragged to court by a scammer. You never know how far you can go until you go too far.2

Is a consented set aside dealt with by the CCBC or transferred to your local court? Just wondering which to contact as haven’t heard a thing about the consented set aside from either.0

The CCBC should have allocated it to the local court. I’d you didn’t receive a Notice of Allocation then ring the CCBC and ask why not and what’s happened to it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have an N180 form to fill in. One question is whether I agree to this case being referred to the small claims mediation service. Is the answer to that a no?0
