If you are doing a defence as well as a WS and evidence, base the defence on the Template Defence (a sticky thread in its own right) but don't send anything to the CCBC at Northampton!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi @Coupon-mad - I thought I had tbh, here's a link to the defence I was working on previously after the set aside hearing:

If stuff has changed I will review it and make edits.

When you say don't send anything to CCBC at Northampton is there a particular reason? Or simply that everything should now go to the Milton Keynes County Court? Thanks for your help.

    Yes.
That 'particular reason' being that the CCBC no longer has any interest in this case.
Your case is being progressed by Milton Keynes County Court.
Does the second page of that Notice of Hearing that you have shown us not say where documents should be sent?

Ok thanks Keith. No, the 2nd sheet doesn't say anything and there's nothing on the back of either. Here it is though:

@Coupon-mad - Just to check, I should restart my defence and change it completely to the new format or incorporate a bit of both into my final one? Only asking as my original defence I felt was quite good, having gone off lots of advise here over the last year or two since this all started. Obviously things change though, so I understand it may need tweaking.  :)

That old defence was for a previous case?  The new one is recommended now.

No, for the same case, that's just how long this has taken from Excel. I won the set aside, they refunded the fee and then I filled in my questionnaire for a small claims court hearing etc for the original claim against me. Excel then took over a year to file etc.

However I didn't know they would take this long, so at the time I cracked on with creating a WS and defence . So this is all still for the same alleged parking charge claim.

When the set aside was granted, didn't the judge order that the claim be re-served within 14 days?

Hi @B789 - this is the Judgement order:

I complied with all points. I submitted my small claims questionnaire, draft defence etc to the court (electronic and by hand) and to the Claimant on time. I received nothing back from Excel at any point, other than a rejection of my offer to settle out of court if they paid my scheduled costs etc. I then received letters in 2023 from Court who were asking for the Claimant to submit their small claims questionnaire etc - so they hadn't done it for over 1.5 years.
