It would appear I've moved to tri-monthly updates! Still nothing from the courts or Excel. I've contacted the court a couple of times to ensure they definitely received everything, which they did.

Hi everyone, I doubt many remember me at this point as it's been a while. I still haven't heard anything back from the court or Excel, part of me wonders if Excel have dropped the case completely without bothering to contact me, as they did refund my N244 fee after I successfully won my set aside hearing..

The court received all my papers etc on time, as I checked. Nothing has reappeared on my credit report erroneously etc. Sod's Law means a letter will likely drop through my door this afternoon now that I'm posting haha!

Also non-thread related but I was deeply saddened with Queen Elizabeth's passing, may she RIP.

Sounds like they discontinued the claim but didn't bother to tell you.

Yes certainly appears that way! Is there a simple way for me to check officially? Regardless of if they have or haven't, thank you to yourself and everyone else who helped me last year, was greatly appreciated.  :)

Email and ask both Excel and the local court and ask them to erase your data if the case is over.

Use the word 'erase' as it's a data right under GDPR.

Hi all. First off, hope everyone had a nice festive period with their loved ones. I received a letter from my local court today dated the 29th December 2022, in regards to the case this thread was created for. The letter is below with personal information redacted. Then below this letter I had a couple of questions etc:

    Letter

Few things of note/questions I had regarding the above correspondence:
    • The letter appears, to my untrained eye, to only be instructing the Claimant (Excel) to do something currently.
    • One of the things that slightly confused me was the fact it refers to have the "order set aside". I have already successfully won a set aside hearing for my CCJ, as documented in this thread. So is this referring to Excel's "claim" as a whole - i.e. if they do not respond then the original claim of the alleged parking charge etc are all to be permanently expunged/struck out? Meaning Excel can officially no longer harass me in the future, one would presume.
    • Finally, my main (probably predictable question) - Do I need to do anything at the moment? For example, should I be checking anything with the court etc.
    • I submitted my N180 Directions Questionnaire in October straight after the original set aside hearing victory, which I have electronic proof of. I also submitted a paper copy by hand to the courts. I assume that's why I'm not being directed to do anything currently as the Defendant. I am surprised the Claimant has been allowed so much leeway, given the deadline for the documents submission passed over a year ago...
Wishing you all a Happy New Year, stay safe. Thanks for your help as always.

I think the "set aside" is referring to this new Order. This new Order is ordering the Claimant to do something, file their DQ. Nothing for you to do except wait and see what happens next.
Ok thank you. So basically the original claim before the CCJ was ever in place, i.e. the alleged parking charge. Well then hopefully they don't reply and this can all be done with for good, as it's frustrating knowing it's not completely concluded (nobody needs or wants that). Excel have ignored all communication from me since the set aside hearing anyway and refunded my £255 fee for it. Can't believe they're been given an additional week after failing to file anything for over a year but hey-ho.

If you have any Spring/Summer 2023 dates you can't do for the PCN hearing, email your court now while they are looking at DQs.
