Paid for parking but still received a fine - how to dispute and resolve ?

    No, I am not saying that.

    I mean they make people register certain identifying data in order to make a complaint and I believe they won’t investigate unless the person has complained to the AOS member firm, first. 
    Might sound minor but in my opinion, such barriers mean it’s easier to complain to the BPA than the IPC.  I expect most people wouldn’t bother after being faced with a portal that puts up barriers like that. 
    But this OP needs to show their evidence to the DVLA Data Sharing team as well as to Napier. No need for me to clarify what ‘don’t send a letter, send an email’ means.

    I have just sent the email to Napier and had an automatic reply.

    Within the automatic reply it states "Appeals regarding Fixed Charge Notices will not be accepted via email"

    So what do I do now ?

    It means they accept general enquiries by email

    It means they accept complaints by email

    It also means they do not accept FCN PCN appeals by email because they have a set procedure for appeals that the appellant must follow

    All typical and perfectly normal , nothing ambiguous about it

    This is an unregulated industry that most of us have been fighting for a decade , won't change until summer 2022 so follow the advice already given because next year's changes won't help you now in 2021

    This time next year , regulation should have started , more than 3 years 3 months after the Parking Bill was given royal assent

    Recorded delivery was discarded many years ago , we now have , signed for , and , special delivery , usually these are signed by the postperson , not the recipient , especially if a p o box is used , so you never get proof of delivery

    Everyday on Facebook people post pictures of deliveries by Hermes etc asking if anyone knows the doorstep or shop counter or location , trying to track down missing deliveries

    Were you sending an appeal? I thought you were sending a complaint.
    A bit of both really, my priority is to get the FCN canceled but I’ve also added concern about the company. 

    Once I have confirmation the FCN is cancelled then I’ll take things further with a complaint to dvla etc

    The email says… 

    Dear Sir or Madam:

    I was surprised and angry to receive this FCN, because I paid for the parking at the machine using my debit card prior to departure.

    I have since contacted my bank and asked them to check for this transaction. 

    My bank confirmed that ‘a payment of GBP 1.50 was authorised towards WILLEN LAKE CAR PARK MILTON KEYNES GB on 6 June 21. The time captured on the system is 17:04 UKT. As the merchant did not collect the payment, the pending amount was returned to your account after 7 days per the normal Visa procedure’.

    My bank has provided this evidence in writing, for reference I have attached a copy to this email.

    I also have a witness who was with me when I paid for the ticket as further evidence – this person paid for their parking using coins instead of a debit card.

    For this reason I decline to pay the fine and I request that you confirm in writing that the FCN is invalid.

    There is also a concern that the payment was not collected thus allowing an FCN to be issued.  This could have happened to other people who may have just accepted the fine and paid it, surely this is something that warrants further investigation by your Company.

    This accusation made against my good name has only heightened the stress and anxiety I am currently under due to unforeseen personal problems.

    I have copied Ben Everitt into this message, the local MP for MK North.

    Please confirm receipt of this message, I await your response.

    So should I go through Napiers online appeal process (in addition to the email I’ve already sent and the letter you suggested I post) ? 

    Or should I avoid using the online appeal process and if so why ?
