    I have made the decision to complain to the Information Commission Office as the Private Parking Company wants 2 pieces of ID from a list as follows.

    Birth Certificate

    Passport

    Driving

    Bank statement

    Utilities bill (not older than 3 months)

    Council tax bill (not older than 12 months)

  • I called the Information Commissioner Office over the failure to process my Subject Access Request due to them not recognising my V5C as identity and asking for excessive ID, in view of the "existing relationship" i.e the PCN the communication they have already sent re the PCN to the email address from which I requested the SAR.  3 months wait with ICO for an outcome I understand from a phone call I made to the them earlier today. I think they try and seek resolution from the SAR requester and the company involved, in this case Minster Baywatch. I sent the online complaint today.

    ICO suggested contacting their association, so I raised a complaint with the BPA. Not expecting much from that, but who knows?

    I just looked at the POFA Explanatory Notes (part of the legislation):


    221.Paragraph 4 provides that the creditor has a right to recover unpaid parking charges from the keeper of the relevant vehicle if the conditions set out in paragraphs 5611 and 12 are satisfied. The creditor is not obliged to pursue unpaid parking charges through this scheme and may seek to do so through other means but they may not use the scheme provided for here to secure double recovery of unpaid parking charges (paragraph 4(6)), nor will they have the right to pursue the keeper, as opposed to the driver, of the vehicle where they have sufficient details of the driver’s identity. The right to reclaim unpaid parking charges from the vehicle keeper does not apply in cases where the vehicle has been stolen before it was parked, (paragraphs 4(2) to (3)), or in certain circumstances where the vehicle in question was a hire vehicle (paragraph 4(7)). The creditor may not make a claim against the keeper of a vehicle for more than the amount of the unpaid parking related charges as they stood when the notice to the driver was issued (paragraph 4(5)).

    I received a response from the British Parking Association (BPA) about Minster Baywatch not following the Information Commission Office about Id's and Subject Access Requests. The essentially said until it can be shown that they have failed respond keep to ICO guidelines about ID then they are not interested. They did however say about the ICO investigation and any outcome that they would be interested in hearing about that.

    Next step to tell Minster Baywatch not to share my information with Gladstone s until the outcome of the ICO complaint.Will they insist on ID for that?!

    I have completed the Consultation highlighting added costs of the pofa limit on costs and the risk of other laws in conflict with adding these so called costs of debt collection. I suggested that when the deterrent idea is used in the consultation it cannot be a deterrent when the keeper is held liable as in my case. The DVLA and ANPR system generated all of my PCNs that I have had directly or indirectly and therefore creating this problem.

    I highlighted if a PPC business model is reliant on PCNs rather than shared parking revenues with the owner of the land if applicable or fee from the owner for running the car park, then there should be a means of limiting their ability to levy PCNs.
