Cotswold Lakes Trust (Charity) Car Park PPC Minster Baywatch now with LBC from Gladstones


I understand that Private Parking Companies read these forums so I am hesitant to write too many details at present about the precise dates and time as my appeal has already gone through the POPLA process without a successful outcome if that is the right phrase.
I'm hesitant to write too much here about the details of what happened when two cars of which I am the registered keeper of both entered a car park owned by a Charity in the countryside and operated by a Private Parking Company park who are members of the BPA and who use the POPLA appeals process.
ANPR evidence that they presented was that a car of which I am registered keeper remained in the car park for a period that exceeded the grace period, they never stated what the grace period was nor was it on the signage, but that BPA latest member code of conduct in operation from 2020 says they must use a minimum period of 10 minutes. The car remained in the car park for less than 15 minutes. I was advised by the company of the precise time.
I made a cash payment to park the other car sufficient for us to complete a linear walk and pick up the paid for parked car. The walk did not exceed the time I paid for, but the time it took to unsuccessfully use the app to pay and then search for cash in the car resulted in the other car receiving the invoice as it had remained in the car park during this time.
There was an appended note to the machine that said to use a cashless app in preference to cash, there was no ability to pay with a debit card on site. All this was in the period of coronavirus restrictions hence the request to use the app where possible. I have a picture of the notice.
I've been through both the company's appeals process and the POPLA process and been turned down for both of course.
So now they want me to pay the sum of £100.
As I see it I have three choices from here
1 I can pay £100 And put this down to experience.
2 I can do nothing and see how much the charges that they add mount up and see if they then take me to court to recover their debt that they see believe I have incurred and fight it in the small claims court.
3 I can pay the £100 and then take them to the government small claims court service to recover the £100.
4 I can write to to the Charity that I assume permit the company to operate the Car Park on its behalf to see if they will intervene.
Any advice or comments would be greatly appreciated.

2) the notional add-ons are irrelevant , if it goes to court it's the £100 plus up to £100 in court and legal fees , making it around £200 if you lost in Court within the 6 year statute under the Limitations Act 1980 , paying in full within one month of the loss in court
3) I doubt that this will work , cost you court fees and unlikely to win , 2) is better
4) should have been done anyway , right from day one , but still worth doing asap , it's plan A in the newbies FAQ sticky thread near the top of the forum , whereas you tried plans B & C instead. Plan A is ALWAYS the best option , regardless

I have emailed the Charity they have explained who owns the land and who leases it. Essentially they appear to be the closely related organisations to the Charity. The Charity confirm they do not intervene in the process of enforcement of parking charge notices in any way which is interesting as they also provide free parking to members of the charity if a car is registered to park with the member.
They also confirmed that they are not prepared to provide any details of the contract to me of the Private Car Parking Company.

I will be sending a Subject Access request to the Parking Operator soon. Nearly 4 years ago they invoiced me for underpayment for parking a vehicle (elsewhere in the UK ), of which I am the registered keeper.0 -
Which parking operator is it please? We can then give you some intel on their likelihood of issuing court proceedings.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Minster Baywatch Lakeside Car Park near South Cerney land owned/ leased by them. Umkomaas ,you will know better than me of course their likelihood of proceeding but it looks like they are proceeding to court with one from probably the same small car park on another thread as far as I can work out.0

No, we don't know the likelihood of proceeding because we don't know who it is.
It will help us if you tell us the name of the PPC and the location of the car park.

Minster Baywatch Redacted Car Park in view of LBC. Sorry MB was an abbreviation for Minster Baywatch in my last post. The other place where in 2017 I received a PCN that they stopped writing letters for me also was Minster Baywatch at removed as Letter Before Claim has arrived. Of course they may now choose to combine the two.1
