    Is there nothing saying that both parties shall file and serve witness statements x days before?
    No, the only time they mentioned witness statements is what I have shown in my previous message. I have copied it below.

    At this appointment the Judge will explore with the parties whether:

    (c) what case directions are required e.g. witness statements, any experts.

    Ah OK then, so you are ready to say 'no' to any settlement and to be robust and firm that you have a good case, whether this Judge thinks you haven't or not!

    I can't see anything myself but I will keep rereading it. I have scanned in three of the pages where they reply to the points made in the defence templace just incase someone else might spot something.

    I see they are citing VCS v Percy. A truly abysmal judgment in my view and one I know about, as does @bargepole.  Boy oh boy, we have seen some appalling judgments from Circuit judges this year, what with HHJ Simpkiss wrongly presuming the costs of £82 were for getting DVLA data!

    What do these circuit judges think the a actual PCN sum covers if not the letter chain?  They seem to think the £100 is a penalty that doesn't have to have commercial justification and cover the costs of the operation.  Then they look at the added £60 and think, "oh there must be a costs implication".

    YES!  IT IS WHAT JUSTIFIES THE PCN SUM BEING HUGE!

    Never mind judgments, what about their evidence photos and how come your ticket had a different car reg in it?  

    If you bought that ticket in good faith and the machine brought forward a wrongly keyed VRM someone had started to input before you got there, fair enough.

    But if a motorist handed you their ticket to display, that is not fair enough (never OK) and you are bang to rights and should offer to settle, IMHO.

    Your decision based on what you know and what their evidence shows.

  • Have you asked to see the ticket log around ST55, when it was issued etc?
    Does it correspond with your ticket.
    Was there a machine fault...

    It may be that the driver of ST55 entered it incorrectly, however the above from castle does help you - and you should introduce it for the court (screenshot the result on the gov site)

    And in other "dodgy" receipt news; the VAT Number 187 0391 47 doesn't exist either.

    Wow thanks Castle, great finds :)  Where can i show that the VAT number dosent exist ?

    Coupon-Mad, My friend purchased the ticket as I drove us from our home town, they could of entered it wrong or it was already inputted as you said.

    Fimacdoodle, it does correspond with my ticket because they said the ticket that I had under the windscreen belongs to that registration, not mine.
