  • Thanks for the support :)

I received a rather 'strange' letter this morning, which had been delivered to the address of an aunt (who I have never lived with), and would appreciate your idea's on how best to respond...

I received a document headed "Judgement for Claimant (in default)" from Milton Keyned County Court, however none of the details seem to tie up - and it's certainly nothing to do with me!

This document was sent, addressed to me, to the address of an aunt - however the address is incorrectly spelt, and as I say above, I have never lived at this address.

The claimant is "Open University Student Budgeting Account", however I have never held one of these accounts - nor have I ever held any credit account of any kind.

The document includes a "defendant's date of birth" however the date is not my DOB, although it is similar (the year is incorrect).

The document states that I have not replied to a "claim form" and there fore it is ordered that I must repay a total of £671.82, by installments of £50 per month.

I am extremely concerned about this, as is the aunt who received the letter. Any idea's on how best to respond would be hugely appreciated. :)

    Cheers,
  • I've just had a quick read through the courts service website, and it would seem that my best course of action would be to complete and send an N244 form, would this be correct?

 Hi marc. sorry can't help you with this but my oh, who is in the middle of a tricky bit of diy atm, might be able to help. Will ask him to look at your post when he's free. HTH

Hi marc don't want to unduly alarm you but we are concerned that maybe this could be identity theft. My oh best advice is to go to the Citizens Advice bureau and also to apply for a copy of your credit file from Experian which costs £2.50 you can order it over the internet. You also could call them and ask for their advice number in Yellow Pages. Hope this helps

    Thanks :)

Unfortunately, I suspect you maybe correct. :( I have already been the victim of ID theft once - although last time it was a member of my family - and was before I even turned 18!.

I'm going to draft out a response letter, and take that with me to the CAB on Monday - to see what they think. My main concern is that bailiffs will turn up at my aunts. :(

On the housing front, I've got 2 flat (sorry, apartment :p ) viewings lined up for Monday and have also stumbled across a quaint little cottage to let, in the perfect area, so I'm going to try and view that too :D

Oh I am so glad you have replied to my post because I was concerned how the idea of this possibility might have affected you. Good job you are off work to hopefully get this sorted. Good luck with the viewings too. X

Don't worry, having been through this once before (and it being my own bl00dy Father! ) I'm more than equal to it...

Thanks for your support and concern, though, it means a lot. :o

hi marc, been reading your diary with interest :) Great news about flat hunting but how terrible about identity theft!

I have a Debenhams cards and they have a free identity check offer at the moment (as long as I cancel after 30 days) so I think I will get mine checked.

Fingers crossed the CAB sort it all out for you :)

A letter has today been sent to the Court, and also to the solicitors who are persuing this 'debt'. I talked it over with the CAB, and showed them the letter I had drafted out, and they agreed with me.

Aside from this, the flats I have viewed today were fantastic, as was a little 2-bed cottage I also went for a look around. I've got a 9am viewing tomorrow morning, and another when the LL finishes work at 17.30. My head and my heart are playing "tug-o-war" at the moment, as the cottage would be the most practical and sensible option - with more space, additional bedroom and marginally lower rent; yet the apartments have the "designer, exclusive" image!!

Just checked my online banking, and my first PP withdrawal of £273.04 has cleared my savings account today - so this is a good chunk of my deposit taken care of. I expect the other payment will show up in the next day or so.

I renewed my mums contents insurance last night for her, saving her over £120 per year and also earning me £60 in CB. :D Next up is her telephone and internet supplier - as she is currently with Bulldog, however they are pulling the PAYG BB service, and so she will lose her telephone service too. Hopefully I can find an equally good deal for her and perhaps earn myself a little CB too... Speaking of CB, I need to update my signature totals!

Went on a shopping spree today, as I had an Argos giftcard due to expire at the end of the month. I got myself a 24pc cutlery set, 5pc knife set and a shelving unit for under a tenner!
