Hi guys. Just wondering if there was any update after the QDR threats. Does anyone know of anyone in Scotland to have had court action over this? I've tried searching on behalf of the person involved but couldn't find any ination. Thanks0

I'm not aware of anyone in Scotland receiving a Simple Procedure Notice (court claim) for a low value claim ... certainly not where QDR have been involved.Jenni x2

On two occassions for a single car park,. Both claims were defended on keeper liability grounds and dismissed. The only other case was long ago when UKPC tried to pursue a single ticket to court with a similar outcome. Costs for the Claimant can be considerable and can't be recovered if the claim is under £300 even if they win. If it goes to Evidential Hearing, they'll be 2x advocate fees to pay - one for Case Management and one for EH.

So the answer is: QDR will NOT sue in Scotland (things might change - FOR NEW PCNS ONLY, OF COURSE - when Scotland idiotically grants 'keeper liability' which they will do in a couple of years).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
