You have known for a long while that you have to write a Witness Statement because that is clearly spelt out in the NEWBIES thread.1

If they comply with section 1 then both of you must comply with section 6 , Napier are the claimant , you are the defendant , it is Napier or their legal contractor who must supply a properly pleaded claim plus fee
Also you must email the court if you don't want the claim heard on papers alone1 -
Ok I’ve just had a look at the newbies thread and can see some template letters etc .. should I object to the court and insist on a hearing ?

Yes, this is spelt out in the Newbies thread. You DO NOT want a case heard on the papers.
The best recent WS example is the one by @jrhys and then you add the judgment by Recorder Cohen QC, as per the recent thread I started.

HI all so I have now got the date for the 8th October for a phone call hearing adn I have to have the papers sendt by the 22nd by 1600 hrs ... I have prepared my witness statement to a degree but cannot access the sample template from a previous case to complete it and I was wondering if someone could send me the link to it as my laptop keeps swashing the text and im unable to read it

Hi all I eventually found the info in the newbie thread ..I submitted my witness statement via email and I received my bundle through the post from the claimant the next day …
The case will be. Phone hearing which will take place this Friday … the claim states in their letter that they will not be in attendance at the hearing and wish for the court to decide in their absence and that they will be represented by an advocate ? I was horrified upon reading my papers that the claimants solicitor has searched the forum and found all my questions and answers and have used this in their witness statement against me … in all honesty this has been hard work and I’ve spent hours trying to fight it and is why I’ve seeked help and have somewhat felt I’m Well out of my league … I will post part of the letter to which they refer to using this site ..0 -

I don't see anything in your thread that undermines your case. Solicitors working on behalf of scammers hate this forum and are trying to undermine your confidence and confuse the judge. As a litigant in person it is perfectly acceptable to use any resource including the internet to research and they have a cheek to accuse you of cutting and pasting when all their letters are exactly that.
If your defence and witness statement are based on the template and recent cases you will have a strong case and it is not non-sensical or irrelevant. You have not shared for comment either your defence or witness statement. What you must do for your hearing on Friday us understand all the points of law that you have referred to and be able to explain them to the judge if asked.

Thank you that has made me feel a little more confident .. I have based it on the template .. should I share it ? It’s the knowing all the points of law I’m worried about … it’s is well out of my comfort one and I’d which I’m worried about ..1
