Parking help please

Hello.

Really sorry to post this here, I did a lot of reading before positing.

So a few months back I started receiving these letters from smart parking which I decided to ignore based on the general advice here. The most previous letter was from CST Law on 28th April giving 14 days to pay £170. If I’m correct then I should ignore these too?


One concern that I do have is that the letters are going to my old address (which is where my parents still reside), so they’re a little concerned. 

I had changed my drivers license when I first moved out, but totally forgot to change my log book. I changed my log book details shortly after receiving the first letter.


Can I appeal/complain to the landowner to try and cancel the ticket, or is it too late?

Am i right in saying they should of issued the first letter within 14 days of the date of parking? As they issued it 17 days later. 


Will the address change be an issue?


Car was only parked for 10 minutes and 10 seconds, i thought 20 minutes was the limit?


I have changed address over now but can I write/email DRP to update them with address to avoid letters being sent to my parents?

    Smart often fail POFA , so 17 days cannot make a keeper liable but they have 6 months to issue to a driver
    This should have been appealed when the postal NTK PCN arrived !! You failed to do so

    Smart have 6 years to issue a court claim pack from the CCBC in Northampton

    It's never too late to complain to a landowner , plan A , so get it done ASAP

    Yes ignore debt collector letters but read the CST letters group thread

    The current grace period is a minimum 5 minutes , it will be 10 minutes when the new CoP arrives next year , it's never been twenty minutes

    Email a data rectification notice to the DPO at Smart parking to get your current address on file , telling them to erase the old one and inform their contractor's too. Attach copies of 2 recent redacted utility bills as proof of I D under the GDPR law , with this current address showing

    What rubbish it says CST Law are acting for Debt Recovery plus who cannot take you to court.

    Smart in fact NEVER use the POFA and have never tried to hold a registered keeper liable, so you as the recipient of the letter are not liable in law, as long as no-one writes a daft appeal or phones them up (DON'T) blabbing about who was driving!

    Clearly you need to email the DPO of Smart Parking (NOT tedious old CST) to tell them to erase that old address and use your current address.  If you move again you must keep doing that for 6 years.  No-one pays these but you MUST see all the letters immediately in case Smart later try a small claim.  Again, you can't be held liable as registered keeper but it may not stop them trying that in the end.

    Errm, no, you didn't, not unless you are in Scotland!  This was a slam dunk cinch to beat at appeal, given they don't know who was driving.  Too late now but you did not read here to ignore it unless you are in Scotland. What you should have read, regardless of where you are in the UK, is the NEWBIES thread PLAN A (which is not merely to appeal). 

    Read the NEWBIES thread properly, and do PLAN A (I'm not telling you what it is, we want you to read the advice thread to learn what you should have done all along).  At NO POINT must you say who parked, so nothing about ''I was only there for xx minutes''!    You are the registered keeper.

    I have complained to MP although I wasn’t really sure how much information to give.

    Is there a general template on what to include when using PLAN A? What shall I include? What shall I avoid saying? 
    I’ve tried to research here but every success story is different.

    In my case, I parked just outside Mcdonalds in the nearest industrial unit. There were no other vehicles parked there. I was there for 10 minutes eating food and making a phone call. 

    This is the reverse side of my Cst Law letter..

    No there is no template for a complaint for obvious reasons.  How effective do you think a silly, generic template complaint would be?!

    Hundreds of recent examples of what people sent are in their threads and they just write it from the heart about how angry they feel.  Loads of them are discussed in SUCCESSFUL COMPLAINTS ABOUT PPCS which is the first link in the NEWBIES thread (recent posts about successes in 2021 are at the end of course).

    Avoid phrases that might give away the driver's identity. Use terms like 'we visited...' or 'the driver did...'
    Keep in mind that the landowner may pass your letter/email direct to the parking company.
