So I have paid the land registry fee and found the landowners address in which I will write to. It is in Guernsey, how should I send this, first class? This is what I was going to write. Any suggestions on what to add/delete? Thank you.
I am writing to you in regards to the PCN issued by Smart Parking to reg Xxxxx on Xxxx
I have already appealed with Smart Parking and am currently waiting on a response. They have failed to comply with several acts of the Protection Of Freedoms Act 2012. They have also sent all letters to an old address, hence the delay in appeal.
The driver, after shopping at the retail park, wasn’t aware of any floor markings, or signs on display, perhaps due to the poor siting and lack of prominence.
No signs were seen that state the terms and conditions or makes drivers aware about a parking charge that they've supposedly 'agreed' to, by stopping here.
The driver has stated that locked gates are now on site, possibly because new parking measures have only recently been introduced or were in the process of change. If so, then BPA COP section 19.10 states that additional signage should be installed to inform visitors of any updates, and to consider a transition period to allow visitors to familiarise themselves with any changes.
Bank statements can be provided to show that the driver and their family have been regular customers in this retail park for several years, but they are now afraid in being issued PCN’s of £170.
Complaints are currently being prepared to submit to the local MP, to the British Parking Association, and DVLA. Further legal advice will also be taken if needs be but hopefully it doesn’t come to this.
The amount of letters being received is borderline threatening and harassment, so hopefully you will cancel this PCN in good faith.

Some people use email. I prefer Royal Mail if there is no urgency.

I couldn’t find an email so have to write.
I have spoke with MP but said they would help if appeal was to fail. So I guess I will appeal first.

Right sorry... I have appealed with Smart Parking.
I am about to complain to landowner with this above message.
Then IF the appeal with Smart is unsuccessful, I will speak again with MP to see if they can help further.
Here are the words of the MP....
“ If you are unsuccessful I would be happy to look further at your case to see if I can be of further assistance. If this is necessary please send me copies of the parking ticket and any correspondence you have with the issuing company, such as the information you mention in you
email”.1 -

Thanks to a few people here, and Ostell over at legal beagles, I managed to get the ticket canceled from appealing via Smart.
