Probably so. It would then come down to whether there is evidence they were offered a fixed term, and agreed to join Tracker on that basis. If a fixed term wasn't discussed prior to joining, then it would be reasonable to correct the error when it was spotted, especially if the tariff recorded on the account does not actually exist. If not, then a conversation needed to be had. Either way, being on a fixed term started prior to 11th December does not protect from this price rise, though it could be argued that if the expiry date was part of the contract agreed, it should not be extended to Feb 2024.bristolleedsfan said:

Yes they do. It's come up a few times. However, the previous fixed term variant did not have protection from a formula change like the current version does. ....what matters is the T's and C's that were in place and you signed up to when you joined. If there was nothing in them that said you were on a fixed term, and you only subsequently formed the impression that you were because of an admin error then you don't really have cause for complaint and are likely to be moved on to a fixed term tariff like everyone else. At least that's how I understand it....

Why? If they want out they want out, the 9 month period to rejoin shouldn't bother them if they're leaving for a cheaper tariff than the new formula. And anyone who wants out can switch away any time they want.MultiFuelBurner said:

OK I can see you are against that idea. I just think they should offer a renew or don't renew option that way yes those with options can try Agile or Cosy then rejoin Tracker if it's not what they like. A nice thing to do, yes, but I don't see the reasoning for it. The 9 month period has been in force for some time, not as if they're only bringing it in with the new formula (in which case yes I would certainly see why you felt that way and would probably agree).MultiFuelBurner said:

Looking at the formulae, Eastern electricity is going up 3.1811p, a 44% increase on the set addition. Fine, it has to be done, and we're always one of the more expensive regions for unit rate. But the gas increase is a mere 0.1846p/kWh, further widening the gap between gas and electricity - slightly galling for an all-electric house out of necessity (there is no gas in the village).
I'll get over it, and I do like the heat pump being much greener than fully burning gas, and Tracker is still saving money, etc. etc., I'm just in a slight grump right now after being confronted with what will be a pretty ginormous price difference between the two fuels.

Ok my reasoning is Octopus are setting up something new, fixed 12 month and you should get a choice with no penalties imo
Just my opinion and I may ask Octopus if they will allow this instead of auto renew or 9 month penalty.
